A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION
OF JOINT POWERS AGREEMENTS BY AND BETWEEN THE
CITY OF VERNON AND THE CITIES OF HUNTINGTON PARK
AND BELL FOR THE DEVELOPMENT AND USE OF HUNTINGTON
PARK PROPERTY ON 2000 GAGE AVENUE (WESTSIDE PARK)
AND BELL PARK PROPERTY ON 6526 WILCOX (VETERANS
MEMORIAL PARK) AS PAIDCS FOR THE BENEFIT OF THE
RESIDENTS OF THE CITY OF VERNON
WHEREAS, the City of Vernon became eligible to apply
for a $20,000 grant allocation under the California Parklands
Act of 1980 which $10,000 could best be used by the City of
Lynwood Park Project, $5,000 by the City of Huntington Park
Project and $5,000 by the City of Bell Park Project; and
WHEREAS, the City Council by Resolution No. 5040
approved the filing of applications by the Cities of Lynwood,
Huntington Park and Bell as agents for the City of Vernon for
state grant moneys pursuant to the California Parklands Act of
1980 for the Lynwood Park Project, the Huntington Park Project
and the Bell Park Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: That the City Council of the City of Vernon
21 hereby approves the Joint Powers Agreements by and between the
22 City of Vernon and the City of Huntington Park and by and between
23 the City of Vernon and the City of Bell, a copy of which has been
24 presented to the City Council concurrently with this Resolution
25 and the City Council hereby orders said Agreements to be
26 received and filed by the City Clerk.

SECTION 2: That the City Council of the City of Vernon
28 hereby authorizes the Mayor to execute said Agreements for~ and

SECTION 3: That the City Clerk of the City of Vernon
3 shall certify to the passage of this Resolution and thereupon

IN OOr;SIDERATION of .the mutual covenants and conditions entered into
" herein, the City of Vernon and the City 'of Bell agree as follows.:
1. The City of Bell' shall administer the Grant Application
which has been submitted or a grant under t e Califoxnia Parklands Pond Act of 1980,

The City of Vernon shall cooperate and assist the City of Bell
in the administration of the Grant Application, -
3. The City of Bell sha11 pay any and all costs of master
plarmng the park to be ve ope at said ROPEP,TY.
4. The-City of Vernon sha11 pay to the City of -Bell ,upon _
`demand, the sum of Five THOUSAND IX?LT ARS ($5 ; 000) is sums represent
the City of L'ernon's share of the development costs of the PROPERTY. In the event.
the City of Vernon is not awarded-said California Parklands Grant, this Agreement
-shall terminate and be of no further force and effect.'
5. The City of Bell sha11 develop the property according
to the agreed Croon master plan.
6. .The City of Bell shall perform mainf.enance and custodial
services for the park after its comQletion. The park shall be operated as part of
he City of Bell park system..
7: The .City of Bell agrees that PROPEPTY must be retained
"for public park, recreation or oFen space in perpetuity, along with a level of
operation and maintenance adequate to insure the maximum utilization of the PF.CP£R^"Y
by the public for recreational purposes and that .the use of the PROPERTY shall be
granted to all residents: of the City'of Vernon on .thee-same conditions that residents
of the City of Bell ,use the PROPEFTY, and that if the~City of Bell-
fails to comply with one or more of these stipulations, the City o Vernon
. has the right to operate and maintain. the project in accordance with the purposes
of_ the ,ant .

8 . -City of Bell recognizes -that this PF~OPEP.TY can
only be used for the express purposes o recreation and that no other use of this
land shall occur. without permission of the State: Legislature.
9. The City of Be11 agrees to allow the use by the City -
of Vernon 'for twenty-five 5 years or the .purpose of meeting the land tenure
requirement of -the 1980 State Bond Act. The City of Belle
shall not have the power to revoke .said use or this A~-reement ing the twenty-five..
(25) year period fromthe date of execution.-
10. The City of Bell agrees to hold harmless and defend
the City of Vernon,..its o icers, agents ..and employees against any and-all claims,
demands, damages; costs, expenses or liabilities .arising out of the'acqusition,
development, construction, operation, and/or maintenance of Bell
Parks.

The City Council has allocated the City's share of the 1980 Parklands
