RESOLUTION NO. 5065
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON APPROVING AN AGREEMENT BY AND BETWEEN
THE CITY OF VERNON AND SOUTHERN CALIFORNIA
EDISON COMPANY FOR THE INTEGRATION AND
INTERRUPTIBLE TRANSMISSION OF NONFIRM ENERGY
PURCHASED BY VERNON FROM THE STATE OF CALI-
FORNIA DEPARTMENT OF WATER RESOURCES
7 WHEREAS, the City of Vernon and the State of California
8 Department of Water Resources are contemplating entering into
9 an agreement to provide for the purchase of surplus nonfirm
10 energy; and
11 WHEREAS, the City of Vernon's electric system is
12 located in a part of the Southern California Edison Company
13 con tro 1 area; and
14 WHEREAS, the Federal Energy Regulatory Commission has
15 approved a partial requirements tariff which provides that
16 Vernon may purchase energy from suppliers other than Southern
17 California Edison Company if said energy is integrated into
18 the Southern California Edison Company control area; and
19 WHEREAS, Southern California Edison Company requires
20 an agreement for the integration and interruptible transmission
21 of said energy; and
22 WHEREAS, the City of Vernon does not agree that the
23 agreement required by Edison is in conformance with the Edison-
24 Vernon 1972 Settlement Agreement nor in conformance with the
25 antitrust laws of the United States and the policies of the
26 Federal Energy Regulatory Commission; however, Edison refuses
27 to permit the integration and interruptible transmission of
28 said nonfirm energy unless Vernon executes the agreement

submitted concurrently herein; and
WHEREAS, the City Council of the City of Vernon
approves the execution of this agreement in an effort to provide
a cheaper alternative source of energy for its customers but
does not waive any rights it has to object to and contest the
validity of Edison's actions herein.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: That the City Council of the City of Vernon
10 hereby finds and determines that the recitals contained herein-
11 above are true and correct.

SECTION 2: That the City Council of the City of Vernon
hereby approves the Agreement, a copy of which has been presented
to the City Council concurrently with this Resolution, but does
not waive any rights it has to object to and contest the
validity of Edison's actions relating thereto, and the City
Council hereby orders said Agreement to be received and filed by
the City Clerk.
SECTION 3: That the City Council of the City of Vernon
20 hereby authorizes the Mayor and the City Clerk to execute said
21 Agreement for, and on behalf of, the City of Vernon.

SECTION 4: The City Clerk of the City of Vernon is here
23 by directed to certify to the passage of this Resolution and there
24 upon and thereafter the same shall be in full force and effect.
