RESOLUTION NO. 5066
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON CONSENTING TO ESTABLISHMENT OF A
PORTION OF REAL PROPERTY TO BE KNOWN AS THE
LOS ANGELES RIVER BIKE PATH LOCATED WITHIN
THE CITY OF VERNON AS A PART OF THE SYSTEM
OF HIGHWAYS OF THE COUNTY OF LOS ANGELES
AND RELIEVING THE CITY OF VERNON FROM ANY
AND ALL MAINTENANCE RESPONSIBILITY AND
LIABILITY FOR THE OPERATION AND MAINTENANCE
OF THE FACILITY
WHEREAS, the Board of Supervisors of the County of
Los Angeles duly adopted on October 26, 1982, a Resolution
declaring that portion of real property, to be known as the
Los Angeles River Bike Path, and located between Atlantic
Boulevard and Florence Avenue as a part of the System of
Highways of the County of Los Angeles, all as provided in
Sections 1700 to 1704 inclusive of the Streets and Highways Code
of the State of California; and
WHEREAS, said Board of Supervisors by said Resolution
requested the City Council of the City of Vernon to give its
consent to acquire rights-of-way, construct improvements and
perform appurtenant work within said portion in the City of
Vernon described above; and
WHEREAS, the City of Vernon will be relieved of any
maintenance responsibilities for the bike path facilities
associated with the use of the bike path through the City; and
WHEREAS, the County Road Department is the agency
implementing the project for the County of Los Angeles and
pursuant to the provisions and conditions of Agreement 11866
entered into between the Los Angeles County Flood Control
District and the County of Los Angeles, February 28, 1967, the

County of Los Angeles assumes all liability in the operation
and maintenance of the facility; and
WHEREAS, pursuant to Section 15101, Class l(c) of
the State Guidelines, the Secretary of Resources designated
this type of project as categorically exempt.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: Consent to Inclusion in County Highways
System.
The City Council of the City of Vernon does hereby
consent to the establishment of that portion of real property,
to be known as the Los Angeles River Bike Path, and located
between Atlantic Boulevard and Florence Avenue within the City
of Vernon, as a part of the System of Highways of the County of
Los Angeles as provided in Sections 1700 to 1704 inclusive of
the Streets and Highways Code of the State of California. Said
consent is for the purpose of acquiring rights-of-way, con-
structing improvements and performing appurtenant work as may
be necessary by the County of Los Angeles.
SECTION 2: Assumption of Liability.
The City of Vernon's consent herein is conditioned
upon the County of Los Angeles accepting the responsibility for
the maintenance of the bike path facilities associated with the
use of the bike path through the City and that the County of
Los Angeles assumes all liability in the operation and
maintenance of the facility.

SECTION 3: Finding of Categorical Exemption.
2 The City Council of the City of Vernon does hereby
3 find that the project is categorically exempt from the
4 requirement for an Environmental Impact Report pursuant to Class
5 l(c) of the State of California's Guidelines for Implementation
6 of the California Environmental Quality Act of 1970.

SECTION 4: Finding of a Minor Nature.
8 The City Council of the City of Vernon does hereby find
9 that pursuant to Government Code Section 65402(b), the aforesaid
10 improvement is for street improvements of a minor nature and
11 that, therefore, the provisions of said Section requiring
12 submission to and report upon said project by the City Planning
13 Agency do not apply.

SECTION 5: The City Clerk of the City of Vernon shall
15 certify to the passage of this Resolution and thereupon and
16 thereafter the same shall be in full force and effect.
