Resolution No. 5139 1 2 3 4 5 6 7 8 9 10 RESOLUTION NO. 5139 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING SCHEDULE VI, EXHIBIT "E", AND SECTION 3 OF RESOLUTION NO. 5120 WHICH AMENDED RESOLUTION NO. 4918 FIXING THE COMPENSATION FOR CERTAIN EMPLOYEES OF SAID CITY AND AUTHORIZING CERTAIN EXPENSE ALLOWANCES WHEREAS, Resolution No. 5120 was adopted by the City Council of the City of Vernon on June 28, 1984, to be effective on July 1, 1984; and WHEREAS, Resolution No. 5120 was previously amended by Resolution No. 5134 adopted by the City Council of the City of. 11 Vernon on August 28, 1984; and 12 WHEREAS, the City Council of the City of Vernon finds it 13 necessary to (i) amend Schedule VI, Exhibit "E", to conf.orm to 14 the Memorandum of Understanding of.September 2, 1984, and (ii) 15 to correct certain omissions in section 30f Resolution No. 5120. 16 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 17 THE CITY OF VERNON AS FOLLOWS: 18 SECTION 1: That the City Council of the City of Vernon 19 hereby finds and determines that the recitals contained herein- 20 above are true and correct. 21 SECTION 2: That Schedule VI, Exhibit "E" of Resolution 22 No. 5120 is hereby amended to provide that (i) the titles of. 23 "Patrolman I" and "Patrolman II" be changed to "Police Officer I" 24 and "Police Officer II" and (ii) that pages 30 through 36 which 25 are attached hereto and incorporated herein by this reference as 26 though fully set f.orth at length be substituted for the previous 27 pages 30 through 36. 28 SECTION 3: That .. Section 3 of Resolution No. 5120 is . t; . ' ~ , 4- , j 1 2 hereby amended to provide as follows: "SECTION 3: That Section 6 of Resolution No. 4918 shall 3 be amended to read as follows: 4 5 6 7 8 9 10 11 12 SECTION 6: That the salaries as set forth in Schedules II through VII are hereby approved and said salaries shall be in full force and effect from and after July 1, 1984, except where otherwise specified in said Schedules. Further, that effective July 1, 1984, the City of Vernon shall make payments to the PERS to satisfy a portion of the employees' obligation to make contributions to the PERS as follows: (a) The City of Vernon shall pay 3.5% of the 13 compensation described in Exhibits "A", "B", "C", "F" and 14 miscellaneous employees described in Exhibits "D" and "E" for 15 the employees of the City of Vernon ;identified in said Exhibits 16 wherein said payments will be credited to the individual employee 17 in satisfaction of one-half of said employee's obligation to 18 make said contribution to PERS. 19 (b) The City of Vernon shall pay 3.0% of the 20 compensation described in Exhibit "D" for the employees of the 21 City of Vernon identified therein (except for miscellaneous 22 employees as set forth in (a) above) wherein said payments will 23 be credited to the individual employee in satisfaction of one- 24 third of. said employee's obligation to make said contribution to 25 the PERS. 26 (c) The City of Vernon shall pay 3.0% of the compen- 27 sation in Exhibit "E" for the Police Chief, Captains and Lieu- 28 tenants (except for miscellaneous employees as set forth in (a) -2- . i 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 above) wherein said payments will be credited to the individual employee in satisfaetionof one-third of said employee's obligationLto ma~e said contribution to PERS. (d) That effective September 2, 1984, the City of Vernon shall pay 3.5% of the compensation in Exhibit "E" on behalf of Police Officers I and II and Sergeants wherein said payments will be credited to the individual employee in satisfacbion of . a portion of said employee.' s obligation to make said contribution to PERS. (e) That effective July 1, 1985, the City of Vernon shall pay an additional 3.5% of the compensation provided for in Exhibits "A", "Bn, "C", "F" and miscellaneous employees described in Exhibits "D" and "E" or in said Exhibits if said Exhibits are later amended pursuant to Section (i) described hereinbelow for the employees of the City of Vernon identified in said Exhibits wherein said payments will be credited to the individual employee in full satisfaction of the employee's obligation to make said contribution to the PERS. (f) That effective July 1, 1985, the City of Vernon shall pay an additional 3.0% of the compensation provided for in Exhibit "D" (except for miscellaneous employees asset. forth in (e) above), or in said Exhibits if said Exhibits are later amended pursuant to section (i) described hereinbelow for the employees of the City of Vernon identified in said Exh~bits and said payments will be credited to the individual employee in satisfaction of two-thirds of said employee's obligation to make said contribution to PERS. (g) That effective July 1, 1985, the City of Vernon -3- 1 shall pay an additional 3.0% of the compensation provided for in 2 Exhibit IIEII respecting the Police Chief, Captains and Lieutenants 3 (except for miscellaneous employees as set forth in (e) above), 4 or in said Exhibits if said Exhibits are later amended pursuant 5 to section (i) described hereinbelow for the employees of the 6 City of Vernon identified in said Exhibits and said payments will 7 be credited to the individual employee "in satisfaction of two- 8 thirds of said employee's obligation to make said contribution to 9 PERS. 10 (h) That effective September 1, 1985, the City 11 of Vernon shall pay 7% of the compensation in Exhibit "Ell on 12 behalf of Police Off~cers I and II and Sergeants wherein said 13 payments will be credited to the individual employee in 14 satisfaction of a portion of said employee's obligation to make 15 said contribution to PERS. 16 (i) In the event the seasonally unadjusted Consumer 17 Price Index for the Los Angeles/Long Beach metropolitan area 18 (all items; 1967=100) as reported by the United States Department 19 of Labor for the period May 1, 1984 and April 30, 1985, exceeds 20 5.25%, then said salaries provided for and set forth in Exhibits 21 "A", "B", IIC", "0", "E" and "p" shall be modified and increased 22 to a sum equal to the existing salary plus the amount obtained 23 by multiplying the existing salary times the percentage rate 24 equal to one-half of the increase in said Consumer Price Index 25 which is greater than 5.25%.11 26 SECTION 4: That in all other respects, Resolution No. 27 5120, as amended by Resolution No. 5134, shall remain in full 28 force and effect and that the provisions in Resolution No. 5120 -4- , . 1 and Resolution No. 5134 not consistent with or in conflict with 2 this Resolution are hereby repealed. 3 SECTION 5: The City Clerk of the City of Vernon is 4 hereby directed to certify to the passage of this Resolution and 5 thereupon and thereafter the same shall be in full force and 6 effect. 7 APPROVED AND ADOPTED this 4th day of September, 1984. 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ATTEST: ~... .. . ~ ..... .~ ~ B~UC V.MALKENHORST, City Clerk -5- 1 STATE OF CALIFORNIA ) ) ss. 2 COUNTY OF LOS ANGELES ) 8 4 I, BRUCE V. Forty ($40.00) for half .a court day or less shall be paid when 18 n appearance by a Sergeant, Police Officer I and Police Officer II 19 s to be made for an off-duty court matter. In the event the 20 Officer. is called to appear for a morning court calendar and 21 remains under court order beyond the noon recess, an additional 22 hirty Dollars ($ 30.00) shall be paid for said appearance. 23 In the event that an Officer is called to appear for an afternoon 24 calendar when he is?ff duty, the sum of Forty Dollars 25 ( $ 4 0 . 00 ) per day shall be paid for said appearance. Court appearances which extend beyond an employee's normal shift assignment shall be compensate as paid overtime unless said paid overtime exceeds Forty Dollars ($40.00) in which event said employee shall receive the sole sum of Forty Dollars ($40.00) as cou1;t appearance compensation. In addition, a Sergeant and Police Officers I and II shall be compensated for "stand by" status when requested by the S\lperior Court, Municipal Court, District Attorney's Office, or the Vernon Police Department in the line of duty outside regular scheduled duty hours as follows: (a) Fifteen Dollars ($15.00 ) for half a court day ending at 1:45 p.m.; (b) Thirty Dollars ($30.00 ) for a full court day; (c) However, if said employee is required to appear in court I hel she shall receive court appearance compensation rather than "stand by" compensation. Promotions or salary increases to higher grades are merit steps only and shall be available to employees ~s recognition and reward for satisfactory service after one (1) year in service at present grade. The promotion orsal.ary increase to said higher grade shall remain. in the sole discretion of .the City Council. Any person who qualifies for said increase shall have his/her anniversary date for future merit increases established as of the date said officer. is appointed'. to said grade. A Police Officer I shall be eligible to be. promoted. to a Police Officer II position after serving at least twelve (12) months as a Police Officer I, Grade 1., and upon receiving a satisfactory merit evaluation. The promotion of a Police Officer I to a Police Officer II position shall not result in reduction in pay, and the Police Officer I being promoted shall be classified in such manner that he/she receives at least a five percent (5%) increase. in pay. for the position to which he/she is promoted. The first one-half hour shall be used for briefing Cind trai~ing purp,oses. Lunch time (code 7) shall be part of the shift and is only compensable if actually interrupted for purposes of an emergency service call, or when code 7 is not allowed, the officer will be compensated for one-half hour straight time or be granted one-half hour code 7 time at a later part of his/her shift. An ,officer whp elects additional compensation shall not be granted additional code 7 time during his/her shift.
