Resolution No. 5156 " 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 5156 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A ~mMORANDUM OF UNDERSTANDING ("MOD"), CALIFORNIA-OREGON TRANSMISSION PROJECT, AND A SUPPLEMENTAL LETTER AGREEr~NT TO THIRD 500-KV AC LINE MOU BY THE CITIES OF ANAHEIM, AZUSA, BANNING, COLTON, RIVERSIDE AND VERNON ("SOUTHERN CALIFORNIA PUBLIC AGENCIES"); CALI- FORNIA DEPARTMENT OF WATER RESOURCES ("CDWR"); PACIFIC GAS AND ELECTRIC COMPANY ("PG&E"), SAN DIEGO GAS AND ELECTRIC COMPANY ("SDG&E"), AND SOUTHERN CALIFORNIA EDISON COMPANY ("SCE"), COLLECTIVELY "INVESTOR-OWNED UTILITIES", THE WESTERN AREA POWER ADMINISTRATION ("WAPA"), TRANSMISSION AGENCY OF NORTHERN CALIFORNIA (" AGENCY II ) AND THE LOS ANGELES DEPARTMENT OF WATER AND POWER (" LADWP" ) WHEREAS, the Agency, the Investor-Owned Utilities, CDWR and WAPA, have carried out studies related to possible alternative methods of developing additional transmission facilities between California and the Pacific Northwest; and WHEREAS, Public Law 98-360 and the Conference Report on H.R. 5653 authorizes the Secretary of Energy ("Secretary") to participate with non-federal entities in developing the California-Oregon Transmission Project ("Project") by upgrading certain facilities and authorizes the Secretary to construct or participate in the construction of such additional facilities as he deems necessary to allow mutually beneficial power sales between the Pacific Northwest and California, and to accept and use funds contributed by non-federal entities, including investor-owned and publicly owned utilities, for that purpose; and WHEREAS, WAPA has published a notice in the Federal Register on August 6, 1984, inviting participation in a new 500 kV line; and , l' 1 WHEREAS, Vernon submitted a statement of interest to 2 WAPA in accordance with said notice; and 3 WHEREAS, the Secretary has entered into negotiations 4 with all interested non-federal entities for the financing, 5 planning and construction of a new 500 kV AC line and associated 6 facilities; and 7 WHEREAS, the Secretary has met with the participants 8 and others and has conferred in and observed the negotiation of 9 the MOU by the participants; and 10 WHEREAS, Mr. Hulett, the personal representative of 11 the Secretary, invited Vernon to attend some of the preliminary 12 negotiations; and 13 WHEREAS, Mr. Hulett, representatives of the Agency and 14 the Investor-Owned Utilities, and CDWR have all participated in 15 the negotiations leading to the final MOU and that Vernon was 16 not invited and did not participate in said negotiations; and 17 WHEREAS, Vernon has met with representatives of SCE 18 and received verbal assurances concerning their assumption of an 19 obligation to provide transfer capability to Vernon if Vernon 20 participates in the third AC line; and 21 WHEREAS, the Project, when constructed, will, parallel 22 in part the DC line between California and the Pacific Northwest, 23 and the operation of the Project may affect the operation of the 24 DC line, and for that reason the LADWP, the operator of the DC 25 line, was invited to be a member of the Management Committee as 26 set forth in the MOU; and 27 WHEREAS, the Project has been evaluated from a 28 technical viewpoint and has been found to be technically -2- . 1 feasible; and 2 WHEREAS, utilities in Northwest and in 3 California have determined that of the Project will 4 provide mutual benefits to their regions; and 5 WHEREAS, in order to d velop the Project in accordance 6 with the MOU, the participants i to take all appropriate 7 actions including the negotiatio execution of a definitive 8 participation agreement, and oth r agreements as necessary; and 9 WHEREAS, the City of V determined that it 10 is desirable and in the best int the customers of the 11 Vernon electric system to enter 'nto the MOU and the Supplemental 12 Letter Agreement to the third 50 AC line MOU respecting the 13 implementation of a provision co sharing of nonfirm 14 energy in participation contract among the participants pursuant 15 to the MOU. 16 NOW, THEREFORE, BE IT SOLVED BY THE CITY COUNCIL OF 17 THE CITY OF VERNON AS FOLLOWS: 18 SECTION 1: The City Council of the City of Vernon 19 hereby finds and determines that the terms and conditions of the 20 MOU and Supplemental Letter Agreement be, and the same are, 21 hereby approved. A copy of said MOU and Supplemental Letter 22 Agreement have been presented to the City Council concurrently 23 with this Resolution and the City Council hereby orders said 24 MOU and Supplemental Letter Agreement to be received and filed 25 by the City Clerk. 26 SECTION 2: That the City Council of the City of Vernon 27 hereby authorizes the Mayor and the City Clerk to execute said 28 MOU and Supplemental Letter Agreement for, and on behalf of, -3- .. 'lI 1 the City of Vernon and the City Clerk is hereby instructed to 2 deliver the executed documents to Lloyd H. Harvego of Resource 3 l-1anagement International, Inc. 4 SECTION 3: The City Clerk of the City of Vernon shall 5 certify to the passage of this Resolution and thereupon and 6 thereafter the same shall be in full force and effect. 7 8 9 APPROVED AND ADOPTED this 18th day of December, 1984. ~~~ L~_ONIS C.
