RESOLUTION NO. 5165
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
VERNON ACCEPTING THE WORK OF FRUITLAND AVENUE
IMPROVEMENT (WEST BOUNDARY TO DISTRICT
BOULEVARD), IN ACCORDANCE WITH CONTRACT NO.
462 OF THE CITY OF VERNON
6 WHEREAS, AMAN BROTHERS, INC. was awarded the Contract
7 for Fruitland Avenue Improvement (west boundary to District
8 Boulevard) pursuant to Contract No. 462 of the City of Vernon;
9 and
10 WHEREAS, Victor H. Vaits, Director of Community
11 Services, has reported to the City Council of the Citv of Vernon
12 that said work has been completed, under date of January 23,
13 1985, and recommends that the work be accepted and payment be
14 made to the Contractor in accordance with the Agreement.
15 NOW, THEREFORE, BElT RESOLVED BY THE CITY COUNCIL OF
16 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: That the work of Fruitland Avenue
18 Improvement (west boundary to District Boulevard), pursuant to
19 Contract No. 462 is hereby approved by the City of Vernon.

SECTION 2: That the total contract amount, including
21 Extra Work Orders and Change Orders, less water meter box repair,
22 is Four Hundred Fifty-Eight Thousand Eight Hundred Eighty Dollars
23 and Thirty Cents ($458,880.30). That there is now due to the
24 Contractor a final partial payment totaling Six Hundred Forty-
25 Two Dollars and Seventeen Cents ($642.17), which should be paid
26 at this time and the remaining ten percent (10%) of the total
27 Contract amount, or the sum of Forty-Five Thousand Nine Hundred
28 Twenty-Three Dollars and Sixteen Cents ($45,923.16), is payable

thirty-five (35) days after the adoption of this Resolution
and the City Council of the City of Vernon hereby directs payment
of said sums as set forth to A14AN BROTHERS, INC. and instructs
the City Clerk to file a Notice of Completion with the County
Recorder.
SECTION 3: That the City Clerk of the City of Vernon
shall certify to the passage of this Resolution and thereupon
and thereafter the same shall be in full force and effect.
APPROVED AND ADOPTED this 5th day of February, 1985.
