Resolution No. 5198 ,~ { 1'. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20' 21 22 23 24 25 26 27 28 RESOLUTION NO. 5198 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ESTABLISHING COMPENSATION FOR THE CITY ATTORNEY, DAVID B. BREARLEY, IN ACCORDANCE WITH THAT CERTAIN AMENDMENT TO THE CITY ATTORNEY EMPLOYMENT AGREEMENT APPROVED BY RESOLUTION NO. 4774 WHEREAS, the Amendment to the City Attorney Employment Agreement was approved and adopted by Resolution No. 4774 on February 17, 1981: and WHEREAS, said Amendment provided, in part, as follows: ".,. .in the event across the board increases in salary are provided for miscellaneous employees, the percentage rates of said increase granted to said employees shall be applied to the retainer salary and hourly rate provided for. . .and said increases shall be effective the same date as the across the board increases are effective for said employees of said City. II and WHEREAS, the City Council of the City of Vernon on June 28, 1984, approved and adopted Resolution No. 5120 providing for the following: (a) an across the board payment of one-half of the miscellaneous employees' obligation to make contributions to the Public Employees Retirement System ("PERS") equal to 3~% of the miscellaneous employees' salary provided for in said resolution to be effective July 1, 1984: (b) an across the board payment of another one-half portion of the miscellaneous employees' Obligation to make contributions to the PERS equal to 3~% of the miscellaneous employees' salary provided for in said resolution to be effective July 1, 1985: and (c) additional compensation effective July 1, 1985 if the rate of inflation exceeds 5~% for the period May 1, 1984 through April 30, 1985: ".", 1 and 2 WHEREAS, Resolution No. 5122, approved and adppted on 3 June 28, 1984, provided for the following: 4 (a) Retainer salary of $3,657.00 per month; 5 (b) Payment of one-half of the employees' contribution 6 in respect to said retainer salary; 7 (c) An hourly fee of $121.64 per hour of legal 8 services in excess of 45 hours per month up to 9 a maximum of 115 hours per month: 10 (d) For all hours per month in excess of 115 hours 11 per month a fee for legal services of $117.53; 12 (e) That effective July 1, 1985, payment of the total 13 employees I contribution in ,respect-toe-the 14 retainer salary in effect; 15 (f) That effective July 1, 1985, an hourly fee of 16 $125.90 per hour of legal services in excess of 17 45 hours per month up to a maximum of 115 hours 18 per month; 19 (g) That the fee for legal services for all hours 20 in excess of 115 hours per month would remain 21 at $117.53; 22 and 23 WHEREAS, the City Council of the City of Vernon, on 24 June 27, 1985, approved and adopted Resolution No. 5197 25 providing for an across the board increase in salary for 26 miscellaneous employees of 2~% to be effective on July 1, 1985; 27 and 28 WHEREAS, pursuant to said Amendment, the City Council -2- .- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 of the City of Vernon intends to increase the compensation for the City Attorney in accordance with said Resolution No. 5197 effective July 1, 1985. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: That the City Council of the City of Vernon does hereby find and determine that the recitals contained hereinabove are true and correct. SECTION 2: That the City Council of the City of Vernon hereby establishes compensation for David B. Brearley, City Attorney, for city attorney services, effective July 1, 1985, as follows: (a) (b) A retainer salary of $3,748.00 per month~ A fee for legal services of $128.93 per hour for every hour of legal services provided in each month in excess of 45 hours up to a maximum of 115 hours~ (c) A fee for legal services of $120.46 per hour for all hours of legal services provided in each month in excess of 115 hours per month. SECTION 3: That in all other respects except as hereinabove provided, the terms and conditions of the City Attorney Employment Agreement dated June 29, 1979, as amended February 25, 1981, shall remain in full force and effect. SECTION 4: That the City Clerk of the City of Vernon shall certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect.
