Resolution No. 5238 '. \ 1 I. 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 5238 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON, CALIFORNIA, CONSENTING TO THE ESTABLISHMENT OF A PORTION OF SOTO STREET WITHIN SAID CITY AS A PART OF THE SYSTEM OF HIGHWAYS OF THE COUNTY OF LOS ANGELES WHEREAS, the Board of Supervisors did on April 23, 1985, and on November 19, 1985, duly adopt Resolutions declaring that portion of Soto Street from 26th Street to Bandini Boulevard and intersecting streets appurtenant to the construction thereof, within the City of Vernon to be a part of the System of Highways of the County of Los Angeles, all as provied in Sections 1700 to 1704 inclusive of the Streets and Highways Code of the State of California; and WHEREAS, said Board of Supervisors by said Resolutions requested this Council to give its consent to allow the County to acquire right-of-way, construct improvements and perform appurtenant work on said portion of Soto Street within the City of Vernon described above; and WHEREAS, pursuant to Section 15063 of the State CEQA Guidelines, the County conducted an initial study and prepared a Negative Declaration. NOW, THEREFORE, BE IT RESOLVED BY ,THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: Finding of a Minor Nature. This City Council does hereby find that pursuant to Government Code Section 65402 (b), the aforesaid improvements are for street improvements of a minor nature and that, therefore, the provisions of said Section requiring the submission to and report upon said project by the City Planning Agency do not apply. ":J' '( 1 SECTION 2: Consent to Inclusion in County Highways 2 System. This City Council does hereby consent to the establish- 3 ment of the portion of Soto Street from 26th Street to Bandini 4 Boulevard and intersecting streets appurtenant to the 5 construction thereof, within the City of Vernon, as a part of 6 the System of Highways of the County of Los Angeles as provided 7 in Sections 1700 to 1704 inclusive of the Streets and Highways 8 Code of the State of California. Said consent is for the 9 purpose of acquiring right-of-way, constructing improvements 10 and performing appurtenant work as may be necessary by the 11 County of Los Angeles. 12 SECTION 3: Approval of Negative Declaration. This 13 City Council does hereby approve the Negative Declaration 14 prepared by the County of Los Angeles Department of Public Works. 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 4: Effect.. on Environment. This City Council does hereby find that the project has no significant effect on the environment. SECTION 5: That the City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. Also enclosed are certified copies of two Resolutions adopted by the Board of Supervisors of the County of Los Angeles declaring a portion of Soto Street within your City to be a part of the County System of Highways for the purpose of acquiring right of way and con- structing improvements. Please present these requests for juris- diction to your duly authorized City officials for their approval. The agreement was prepared based on correspondence between Mayor Leonis C. Malburg and Supervisor Edmund D. Edelman and calls for the County to do the preliminary engineering, acquire the right of way and administer the project with the City paying one-half of .the project costs. Under the terms of the agreement, the City is to assign its remaining available City FAU funds to the County, estimated at $5,300, and to deposit other City funds estimated at $894,700, after opening of construction bids and upon demand, to cover the City's share of the cost of the project. The City's actual share will be based upon a final accounting after comple- tion of the project. We understand that LACTC has given your City a time extension to January 1, 1986 to obligate the City's lapsing FAU funds. Full execution of this agreement prior to that date will obligate these funds and prevent their lapsing. Mr. Bruce V. Malkenhorst -2- December 4, 1985 If the proposed agreement is satisfactory, please present it to your duly authorized City officials for approval and execution at their next Council meeting. Upon execution, please return the three originals of the agreement to the Department of Public Works for further processing. After final approval by the Board of Supervisors, we will return the fully executed City original to your City. Pursuant to Section 15063 of the "State CEQA Guidelines", we have conducted an initial study concerning possible effects of this project on the environment and have prepared a Negative Declaration which includes this study. Therefore, in accordance with Section 15096 of said guidelines and in order to expedite processing, we are also enclosing a copy of this Negative Declaration. If you concur with the Negative Declaration for this project, please pre- sent it to your duly authorized City officials for their approval and finding of no significant effect on the environment. However, if your Council is unable to make the necessary environmental finding, Council action granting jurisdiction should be deferred until the environmental finding can be made. It should be noted that Sections 1701 and 1850 of the Streets and Highways Code provide that the City may consent to the County's re- quest for jurisdiction by Resolution. In addition, Section 65402 (b) of the Government Code provides that the City Council may find in such Resolution that the project involves improvements of a minor nature. Enclosed is a draft of a Resolution containing the finding which, if enacted, will meet the requirements of these statutes and expedite the project. LOCATION AND DESCRIPTION OF PROJECT The Soto Street Bridge is located over the Los Angeles .River in the City of Vernon. The project covers a distance of approximately 440 feet. The project is to widen the bridge to Secondary-Highway standards to create a smooth transition with the.fully improved roadway on either end. The project will widen the bridge from the.-existing 40 feet to 64 feet between curbs to provide two standard .width traffic lanes in 'each direction, two seven foot sidewalks and a center median to separate opposing traffic. 2. MITIGATION MEASURES INCLUDED IN THE PROJECT TO AVOID POTENTIALLY SIGNIFICANT EFFECTS No potentially significant effects resulting from implementing the project. ..have been identified. Therefore, no extraordinary mitigation-measures are included in the project. 3. FINDING OF NO SIGNIFICANT IMPACT Based on the attached Initial Study, it-has been determined that the project. will not have a significant effect on the environment. INITIAL STUDY SOTO.STREET BRIDGE OVER THE LOS ANGELES ~tIVER This Initial Study was prepared by the County of Los Angeles Department. of Public Works pursuant to the California Environmental Quality Act of-1970 (Division 13, California Public Resources Code), as amended, and. the "State. EIR Guidelines" (Division 6, California Administration Code). 1. LOCATION AND .DESCRIPTION OF PROJECT - Soto Street. is an i.~p©rtant north-south highway route from Mission Road in E1 Sereno to the intersection with Slauson Avenue in Huntington Park, a distance of approximately 6.4 miles.. The project is the Soto Street Bridge which spans 440 feet over the Los Angeles River between 26th Street and 37th Street (Bandini Boulevard) in the City of Vernon. The purpose. of the project is to-widen the bridge to Secondary Highway standards to meet'the fully improved roadways on either end. The project will widen the bridge from the existing 40 feet `to 64 feet between curbs to provide two standard width traffic lanes. in each direction, two seven foot sidewalks and a center median to separate traffic. The Soto :Street bridge is a six span reinforced concrete open spandrel-arch. The arches are arranged symmetrically and their lengths .are 62', 71',.73', 73' 71' and 62'. The bridge .will be widened symmetrically about-the center. No piers will be added but the existing piers will be lengthened approximately:. 20' on either side. New pier noses will be streamlined to minimize the catchment of debris that floats down the river during the rainy season.. -The traffic count on Soto Street is quite high, 48,000 average daily traffic with 20~ trucks.- Approximately 0.28 acre of right of way will be acquired for the project. 2. COMPATIBILITY WITH THE GENERAL-PLAN Soto Street is classified in the Leos Angeles County General Flan as a Major Highway. Most of the existing roadway is improved to Secondary Highway Standards. The proposed improvements for the bridge are consistent with .Secondary Highway classification.. 3. ENVIRONMENTAL SETTING Surrounding Property Soto Street, within the project area,.:traverses on urban area .zoned M, MS-1, and MLS-3, which are defined as industrial, manufacturing-and .business, metal foundaries, chemical laboratories,-'.and. oil. refining and storage facilities. The area is an extensively .developed industrial park. There is very little vegetation. -1- A Historic Property Survey Report was prepared to evaluate the historic significance of the Soto Street bridge. The Historic Evaluation determined that the bridge does not meet the. National Register Criteria For Listing in the National Register of Historic Places for the following reasons: 1. -The bridge was built in an already well established area and it did not make a significant contribution to the history. of the area. 2. The bridge is not associated wtih the lives of significant people. 3. There are a considerable number of similar bridge types in the Los Angeles .County. The Soto.Street Bridge is neither unique nor: an outstanding example among these. 4. The bridge is not likely to yield information important to prehistory or history. The Historic Property .Survey was reviewed and approved by the Federal Highway. .Administration and the State Historic Preservation Officer. EXISTING BRIDGE FACILITIES Presently, the Soto Street Bridge is 53 feet wide, providing 40 feet for four substandard traffic lanes and two five feet sidewalks. IDENTIFICATION OF ENVIRONMENTAL EFFECTS Right of Way Acquisition .Approximately 0.28 acre of right o£ way will need to be acquired.. This con- sists of 5 feet-along the length of both sides of the bridge. No-right of way is needed from either end of the bridge. .Since all of the right of way. will be acquired from the channel area, there will be no impacts associated with people, businesses,- structures, or :vegetation. Traffic The existing bridge has four .traffic lanes. -The. widening will increase the width of the travel .lanes but there will not be an addition of lanes. The traffic will not increase as a result of the project. Noise Because the traffic characteristics do not change, there will be no change in -the traffic generated noise levels. The surrounding area has a high ambient noise .level.-.due to the heavy industry and he great number of trucks using the roadways. There are no noise. sensitive locations in the vicntiy of the proj- ect. Therefore, the improvement of the Soto Street Bridge will have no impact on the noise level. -2- Air Quality Again, since. there are no changes in the traffic characteristics, the project will have no impact on the. regional air quality. Plant Life No vegetation will need to be removed as a result of the project. Safety and Convenience The existing bridge consists of four substandard traffic lanes (10 feet each). There have been 39 accidents within 5 years in the vicinity of the bridge The additional width of the travel lanes and the median to separate opposing traffic will increase-the safety for motorists. The sidewalks will be widened, anus improving the safety for pedestrians. The widening should significantly .reduce congestion and improve safety, comfort, and convenience for motorists. Aesthetics The primary architectural element of the bridge, the six span reinforced concrete open spandrel arches .will not be altered. The primary impact on the aesthetic quality will be the replacement of the existing concrete rai.1- ings. Railings designed to current safety standards will be installed. Use of Fuel- Because the project will not affect the volume or composition of traffic, the project will not result in the increased consumption of fuel by motor vehicles.. The project construction will require the consumption of fuel and the use of petroleum-based materials; however, this'is not considered to involve using fuel or energy in a wasteful manner. Construction Phase Impact The work will cause. some dust and an increase in the noise level.. and there may be some inconvenience to the motorists and pedestrians; however, these conditions usually-occur for only a-short period of time and have no perma- nent effect on the environment. To abate dust nuisance, the contractor is required by the project specifications to provide cleaning, sweeping, and sprinkling with water, as necessary, throughout all phases of construction. In addition, the contractor must adhere. to .the. requirements of applicable local ordinances regarding dust and noise control. Although there will be some minor inconvenience experienced by residents because of limitations on the ease of access during construction, access to ,property will be maintained by the contractor except for short periods of time when it is impractical. to do so. 5. CUMULATIVE: IMPACTS The primary cumulative impacts which might be associated wiah roadway con- struction are the displacement of people and businesses, included community. .growth and changes i.n motor. vehicle-usage and the resulting impact on regional air quality. _3_ As previously discussed in the Initial Study, the project is not expected to have any adverse .impact on the displacement of people and businesses, regional motor vehicle usuage, community growth or air quality. 6. DISCUSSION OF WAYS TO MITIGATE-SIGNIFICANT EFFECTS No significant effects. resulting from implementing the project have been identified . 7.
