A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OP VERNON DETERMINING THE DISABILITY RETIREMENT
OFARTHLJR N. MIEKOSl, A LOCAL SAFETY MEMBER
EMPLOYED BY THE CITY OF VERNON [Sections 21024 8<
21025 of the Government Code]
WHEREAS, the City of Verhon <hereinafter r-eferred to
as "AC;Jency") is a contracting agency of the Public Employees
Reti,'"eHnent System; and
WHEREAS, the Public Empl.oyees Retir-ement L~"iw r-equires
that a contracting a<]ency determi.newhether an employee of such
Agency in employment in which he is classified .::'IS a L.ocal Safety
Member is disabled for the purposes of the Public Employees
Retir'ement Law and whethel'" such disability is "industrial"
within the meaning of such law; and
WHEREAS, by this Resolution the Agency is hereby
filing an C;'lpplicatiori for the disability retirement c)f ARTHUR N.
MIEKOSZ employed by the Agency in the position of Fil';'efif,.Jhtelr in
the Vernon Fire Department; and
WHEREAS, the City Council of the Agency has reviewed
the medical and other evidence relev~nt to such
alleged
disability; and
WHEREAS, such "industr-ial" disab:ility wa!s not causE.'d
by third party liability.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION
1 :
That the Agency hereby finds
and
determi.nes that ARTHUR N. MIEI<OSZ is incapaci tated wi thin the
meaning of the Public Employees Retirement Law from the
performance of his duties in the position of Firefighter in the

a pel"manent nature, and said ARTHUR N. MIEI<OSZ is removed from
U",e Agency paYI~oll on Februal~Y 16, 1986.
SECTION 4:
That. the City Clerk of the Agency shall
certify to the pissagecf this Resolution and t.hereupon and
thereafter t.hesame shall be in full force and effect..
