RESOLUTION NO. 5251
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
3 OF VERNON ESTABLISHING AN AUTOMOBILE ALLOWANCE
FOR CITY COUNCIL ~mMBERS OF THE CITY OF VERNON

5 WHEREAS, Section 1223 of the Government Code of the
6 State of California provides that an official of a city may be
7 provided an allowance for the use of his vehicle in the
8 performance of his duties; and
9 WHEREAS, the court held in the matter of Citizen
10 Advocates, Inc. v. Board of Supervisors of Stanislaus County
11 (8/83) 146 C.A. 3d 171 that the Board of Supervisors of a
12 county may authorize vehicle allowances for county officials
13 pursuant to Section 1223 of the Government Code of the State of
14 California; and
15 WHEREAS, the City Councilmen of the City of Vernon
16 regularly use their privately owned or leased vehicles to
17 conduct city business while in the performance of their duty
18 as Councilmen; and
19 WHEREAS, Resolution No. 5096 was adopted by thee'City
20 Council of the City of Vernon on March 20, 1984, which established
21 an automobile allowance of $25.00 per month; and
22 WHEREAS, the City Council of the City of Vernon wishes
23 to provide for an increase in said automobile allowance.
24 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
25 THE CITY OF VERNON AS FOLLOWS:
26 SECTION 1: That the City Council of the City of Vernon
27 does hereby find and determine that the recitals contained
28 hereinabove are true and correct.

SECTION 2: That the City Council of the City of Vernon
hereby establishes pursuant to Section 1223 of the Government
Code of the State of California an automobile allowance for
all City Councilmen who maintain a privately owned or leased
vehicle in the sum of $50.00 per month effective April 1, 1986.
SECTION 3: That the City Clerk of the City of Vernon
shall certify to the passage of this resolution and thereupon
and thereafter the same shall be in full force and effect.
APPROVED AND ADOPTED this 18th day of February, 1986.
