A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON ACCEPTING THE BID OF EXCEL PAVING
COMPANY FOR SUNOL DRIVE AND AYERS AVENUE
RECONSTRUCTION AND BANDINI BLVD. MEDIAN, IN
ACCORDANCE WITH CONTRACT NO. 473 OF THE CITY
OF VERNON AND APPROVING THE EXECUTION OF
SAID CONTRACT
WHEREAS, Contract No. 473 of the City of Vernon was
approved by the City Council of the City of Vernon, pursuant to
Resolution No. 5310, and sealed bids were opened on September 2,
1986; and
WHEREAS, said bids were referred to Victor H. Vaits,
Director of Community Services, who has reported to the City
Council under the date of September 4, 1986, recommending that
the contract for Sunol Drive and Ayers Avenue Reconstruction and
Bandini Blvd. Median be executed with Excel Paving Company on
the basis of its bid in the sum of Six Hundred Sixteen Thousand
Four Hundred Eighty-Six Dollars and Seventy Cents ($616,486.70>,
being
contract
the
lowest responsible bid meeting
the
requirements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:

The City Council of the City of Vernon
does hereby award Contract No. 473, in accordance with the
recommendation of Victor H.
Vaits, Director of Community
Services, and authorizes the Mayor to execute said Contract on
behalf of the City.

All other bids are rejected and the City
Treasurer is hereby directed to return to unsuccessful bidders
any cashier or certified checks deposited with said bids upon

1 the receipt of an executed contract from Excel Paving Company,
2 accompanied by all required bonds and certificates.

~sQIIQ~_~: The City Clerk of the City of Vernon shall
4 certify to the passage of this Resolution and thereupon and
5 thereafter the same shall be in full force and effect.

4 municipal corporation., ('''Vernon") and Joseph T, Ryerson & Son
5 Inc., a Delaware corporation (''~yerson").

7 The City of Vernon requires frontage improvements as
8 described in Exhibit "'A'' per Building Plan Check No. 59856001.
9 AGREEMENT
10 NC;W, THEREFORE, in consideration of the premises and
11 the promises hereinafter set forth., the parties agree as
12 follows:
13 FfiRST: In considexat.on Qf the City's.. constructing the
14 public improvements on ~unol Drive in the City of Vernon,
15 California as more particularly described in Exhibit ''A''
16 attached hereto, P.yerson shall either pay the sum of Twenty
1% Three Thousand Dollars (:$23,000) to the City, or Ryerson
18 shall deliver to Vernon, a, per~oxmance bond in the amount of
19 Twenty Three Thousand Dollars (_$23,000) in a form approved
20 by the City. Such bond shall remain in effect through"December 31, 1987.
21 if Ryerson opts to execute a bond, such bond shall become
22 payable in fu11 when said construction is commenced by the
23 City of Vernon or its contractor.
24 SECOND: Any notices, demands oar other communications
25 required or desired to be given or made under the terms of
2G this-agreement sha11 be in writing and personally served or
27 served by registered or certified mail, return receipt
28 requested, deposited in the United States mail with postage

EXHIBIT "A"
Improvements shall be constructed along the southeast property
line and along 41.3 feet of the northeast property line beginning
at the northeast corner of the lot located at 4310 Bandini Boulevard,
more partculary described in the Grant Deed located in Book 22251
at Page 3Q5 of the Official Records in th.e County Recorders office
of the County of Los Angeles, Mate of California. Street improvements
shall include asphalt and concrete removals, new sidewalk, curb
and gutter, dri,~reway-and curb drains where necessary,.. and all
constructed to City of Vernon Standards.
