1 RESOLUTION NO. 5398
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON APPROVING AND AUTHORIZING THE
3 EXECUTION OF A SPECIAL USE PERMIT BETWEEN
THE CITY OF VERNON AND THE FOREST SERVICE,
4 U.S. DEPARTMENT OF AGRICULTURE RESPECTING
THE BEAR BUTTE HYDROELECTRIC PROJECT, FERC
5 NO. 8444
6 WHEREAS, the Forest Service, U.S. Department of Agricul-
7 ture ("USFS") requires the execution of a Special Use Permit and
8 the deposit of fees for an experimental and demonstration permit
9 relating to the Bear Butte Hydroelectric Project on the Pineridge
10 Ranger Districtr and
11 WHEREAS, the City Council of the City of Vernon wishes
12 to enter into a Special Use Permit with the USFS for the purpose
13 of conducting archaeological inventory and ethnographic research
14 in conjunction with the proposed Bear Butte Hydroelectric
15 Project, FERC No. 8444.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
17 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: That the City Council of the City of Vernon
19 hereby finds and determines that the recitals contained
20 hereinabove are true and correct.

SECTION 2: That the City Council of the City of Vernon
22 hereby approves the Special Use Permit, a copy of which has been
23 presented to the City Council concurrently with this resolution,
24 and the City Council hereby orders said Permit to be received and
25 filed by the City Clerk.

SECTION 3: That the City Council of the City of Vernon
27 hereby authorizes the Mayor to execute said Permit for, and on
28

1 behalf of, the City of Vernon and instructs the City Clerk to
2 return the same with the necessary fees to the USFS.

SECTION 4:
The City Clerk of the City of Vernon shall
4 certify to the passage of this resolution and thereupon and
5 thereafter the same shall be in full force and effect.
6 APPROVED AND ADOPTED this 16th day of June, 1987.
