RESOLUTION NO. 5456
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON ACCEPTING THE WORK OF EXCEL PAVING
COMPANY IN ACCORDANCE WITH CONTRACT NO. 474
OF THE CITY OF VERNON
WHEREAS, EXCEL PAVING COMPANY was awarded the contract
for work on 49th street, Storm Drain and Paving, pursuant
to Contract No. 474 of the City of Vernon; and
WHEREAS, Victor H. Vaits, Director of Community
Services, has reported to the City Council of the City of
Vernon on December 22, 1987, that said work has been completed
and recommends that the work be accepted and payment be made
to the Contractor in accordance with the agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF VERNON AS FOLLOWS:
SECTION 1: That the work of EXCEL PAVING COMPANY,
pursuant to Contract No. 474 is hereby approved by the City
of Vernon.
SECTION 2: That the total contract amount is
Four Hundred Seventy Thousand, Three Hundred Twenty-four
Dollars, Ninety-five Cents. ($470,324.95). That there is
now due to the Contractor a final partial payment totaling
One Hundred Forty One Thousand, Four Hundred Eighty-seven
Dollars, one Cent ($141,487.01), which should be paid at this
time, and the remaining ten percent (10%) of the total contract
amount, or the sum of Forty-seven Thousand, Thirty-two Dollars
Fifty Cents ($47,032.50) is payable thirty-five (35) days
after the adoption of this resolution and the City Council
of the City of Vernon hereby directs payment of said sums

1 as set forth to EXCEL PAVING COMPANY and instructs the City
2 Clerk to file a notioe of completion with the County Recorder.
3 SECTION 3: That the City Clerk of the City of Vernon
4 shall certify to the passage of this resolution and thereupon
5 and thereafter the same shall be in full force and effect.
6 APPROVED AND ADOPTED this 5th day of January 1988.
