A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON DETERMINING THE INDUSTRIAL DISABILITY
RETIREMENT OF GEORGEF. BASS, A LOCAL SAFETY
MEMBER EMPLOYED BY THE CITY OF VERNON
(Government Code Sections 21024 and 2l025)
WHEREAS, the City of Vernon (hereinafter referred to as
6 "Agency") is a contracting agency of the Public Employees'
7 Retirement System: and

WHEREAS, the Public Employees' Retirement Law requires
9 that a contracting agency determine whether an employee ,of such
10 agency in employment in which he is classified as a local safety
11 member is disabled for purposes of the Public Employees'Retire...
12 ment Law and if so, whether such disability is "industrial"
13 within the meaning of such law: and
14
WHEREAS, by this Resolution the Agency is hereby filing
15 an application for the disability retirement of George F. Bass
16 employed by the Agency in the. position of Fire Chief in the Ver-
\
17 non Fire Department: and
18
WHEREAS, by letter dated January 6, 1988, Bruce V.
19 Malkenhorst, the City Administrator, notified George F. Bass, that
20 the matter of his disability retirement based on the findings of
21
the doctors would be considered by the City Council and requested
22 notification if he wished to address the Councilr and
23
24 reviewed the medical and other evidence relevant to such alleged
25
26
WHEREAS, the City Council of the City of Vernon has
disabilityr and
WHEREAS, such "industrial" disability was not>caused by
27 third party liability.

1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
2 THE CITY OF VERNON AS FOLLOWS:
3 SECTION 1: That the City Council of the City of Ver:p.oh
4 hereby finds and determines that George F. Bass is incapacitated
5 within the meaning of the Public Employees' Retirement Law" from
6 the performance of his duties in the position of Fire Chief in
7 the Vernon Fire Department.
8 SECTION 2: That the City of Vernon hereby finds and
9 determines that such disability is the result of injury or dis-
10 ease arising out of and in the course of employment and neither
11 the City Council of the City of Vernon nor George F. Bass has ap-
12 plied to the Workers' Compensation Appeals Board for a determina....

SECTION 3: That the City Council of the City of Vernon
hereby determines from the report of Dr. Bruce S. Gillis that
George F. Bass is unable to substantially perform the duties of
his position as Fire Chief and therefor should be retired and
that the permanent and stationary date for retirement. purposes
will be January 30, 1988, and that GeorgeF. Bass will be retired
effective January 30, 1988.

SECTION 4: That the City Clerk of the City of Vernon
shall certify to the passage of this resolution and thereupon and
3 thereafter the same shall be in full force and effect.
