RESOLUTION NO. 5537
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON GRANTING A VARIANCE TO U.S. GROWERS COLD
STORAGE, INC. FROM THE AMENDED INTERIM ZONING
ORDINANCE, SECTION 4.26, MINIMUM AUTOMOBILE
PARKING REQUIREMENTS AT 2045 VERNON AVENUE IN
THE CITY OF VERNON
WHEREAS, the City Council of the City of Vernon held a hearing on said
application for a variance on July 26, 1988; and
WHEREAS, the plans for construction were received by the City on
September 3, 1987 and approved on January 7, 1988 based on Ordinance 801 for
one occupant; and
WHEREAS, the physical condition of the property is unique in that the
buildings have been constructed as cold-storage facilities which are not
likely or intended to be converted to manufacturing or other uses permitted
in the M-Zone which have more intensive parking requirements; and
WHEREAS, there will be 130 parking spaces provided which appears to be
sufficient for the three companies and there should be no adverse affect on
residents 'or property owners within the vicinity of said site; and

1 WHEREAS, the application of the off-street parking requirements will
2 create an unreasonable hardship by requiring 17~ parking spaces; and
3 WHEREAS, U,S. Growers Cold Storage, It's It Ice Cream and S & J Trucking
4 wi 11 be the only occupants at 2045 Vernon Avenue and have i ndi cated that they
5 have no present plans to alter the building configuration or intensity of use.
6 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON
7 AS .. FOLLOWS:
8 SECTION 1: That the Ci ty Counci 1 of the Ci ty of Vernon hereby fi nds and
9 determines that the recitals contained hereinabove are 'true and correct.
10 SECTION 2: That a variance be granted to U.S~ GrowersCdld Storgeat
11 2045 Vernon Avenue. Subject to certain condition provided below.
12 SECTION 3: That this variance is conditional upon the current intensity
13 of use of the cold-storage facility and the accessory ice cream and trucking
14 uses remaining the same, and that any change in said uses or in the
15 configuration of the buildings or the parking areas for said uses shall
16 constitute suffi cient grounds for the Ci ty Council of the City of Vernon to
17 void this variance and require the application of the authorized parking
18 requi rements.
19 SECTION 4: That the City Clerk of the City of Vernon shall certify to
20 the passage of this Resolution and thereupon and thereafter the same shall
21 be in full force and effect.
22 APPROVED AND ADOPTED this 26th day of July 1988.
