Resolution No. 5547 '''.-1 ;; ~.'" . . . , ..' , . . 1 RESOLUTION NO. 5547 2 3 4 5 6 7 permit for a building which requires a variance from the Amended 8 A RESOLUTION OF THE C:rTY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO TEXTILE INDUSTRIES FROM THE AMENDED INTERIM ZONING ORDINANCE, SECTION 4.2.8, DEVELOPMENT STANDARDS, FOR PROPERTY LOCATED AT 4220 CHARTER STREET.IN THE CITY. OF VERNON WHEREAS, Textile Industries has applied for an occupancy Interim Zoning Ordinance, Section 4.2.8, Development Standards, 9 for property located at 4220 Charter Street; and 10 WHEREAS, the physical condition of the property is unique 11 in that the existing 18,309 square foot building was constructed 12 with a 48 foot long truck dock measured from the street right-of..... 13 way and 18 .feet wide; and 14 WHEREAS, Interim Zoning Ordinance Section 4.2.7 requires 15 two loading spaces for a building between 8,001 and 25,000 square 16 feet in floor area, Section 4.2. 8c specifies that each loading 17 space shall be a minimum of 10-feet wide and 65-feet long, and 18 Section 4.4. 4c provides tha.t a non-conforming building', must 19 comply with these standards with any changes in occupancy unless 20 a variance is granted ; and 21 WHEREAS, the application of the development standards for 22 truck loading space sizing requirements will create an unreasonable 23 hardship by requiring that two 65 foot long by 10 foot wide spaces 24 be provided; and 25 WHEREAS ,Textile. Industries has indicated that they have 26 no plans to expandor.a1terthe building configuration and that 27 one loading dock is sufficient for the us.e intended; and 28 WHEREAS, 4220 .Charter Street is located in the M zone and ~ - 2 - t" ,. .. (I ..,. ~ . ~ . 1 Textile Industries operation is consistent with the objectives of 2 the General Plan and Zoning Ordinance; and 3 WHEREAS, the City Council, of the City of Vernon held a 4 hearing Oh said application for a variance on September 6, 1988. 5 NOW, THEREFORE, BE IT. RESOLVED BY THE CITY COUNCIL OF THE 6 CITY OF VERNON AS FOLLOWS : 7 SECTION I: That the City Council of the City of Vernon 8 hereby finds. and determines that the recitals contained herefn- 9 above are true and correct. 10 SECTION 2.: That a variance from the requirement for two n loading spaces be granted oncondi tion that the existing loading 12 space be. maintained. 13 SECTION 3: That a variance from the loading space size be 14 granted to Reliable Tape Products at 4220 Charter.. Streetsubj ect 15 to the condition that the usage Of the loading space be limited to 16 vehicles with a maximum length of 48 feet. 17 SECTION 4.: That noncompliance with these conditions shall 18 constitute sufficient grounds for the City Council of the City of' 19 Vernon to void this variance and require the application of the 20 authorized truck loading space requirement. 21 SECTION 5: .
