Resolution No. 5578 . . 1 RESOLUTION NO. 5578 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO UNITED CONNECTIONS, INC. FROM THE AMENDED INTERIM ZONING ORDINANCE, SECTION 4.2.8, DEVELOPMENT STANDARDS, FOR PROPERTY LOCATED AT 5015 HAMPTON STREET IN THE CITY OF VERNON. 3 4 5 6 WHEREAS, United Connections Inc. has applied for an 7 occupancy permit for a building which requires a variance from 8 9 10 11 12 13 14 15 16 the Amended Interim Zoning Ordinance, Section 4.2.8, Develqment Standards, for property located at 5015 Hampton Street; and WHEREAS, the physical condition of the property is unique in that the existing 10,560 square foot building was con- structed with a separate truck dock measuring 47.0 feet from the street right-of-way and 11 feet wide; and WHEREAS, Interim Zoning Ordinance Section 4.2.7 requires two loading spaces for a building between 8,001 and 25,000 square feet in floor area, Section 4.2.8c specifies that 17 each loading space shall be a minimum of 10-feet wide and 65 feet 18 19 20 21 22 23 24 25 26 27 28 long and Section 4.4.4c provides that a non-conforming building must comply with these standards with any changes in occupancy unless a variance is granted; and WHEREAS, the application of the development standards for truck loading space sizing requirements will create an unrea- sonable hardship by requiring that two 65 feet long by 10 feet wide spaces be provided; and WHEREAS, United Connections Inc. has indicated that they have no plans to expand or alter the building configuration and that the 11 feet wide by 47.0 feet long loading space is sufficient for the use intended; and 1 WHEREAS, 5015 Hampton Street is located in the M zone 2 and their operation is consistent with the objectives of the 3 General Plan and Zoning Ordinance; and 4 WHEREAS, the City Council, of the City of Vernon held a 5 hearing on said application for a variance on December 13, 1988. 6 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 7 THE CITY OF VERNON AS FOLLOWS: 8 Section 1: That the City Council of the City of Vernon 9 hereby finds and determines that the recitals contained hereinabove 10 are true and correct. 11 12 SECTION 2: That a variance from the requirement for 13 two loading spaces 10-feet wide by 65-feet long be granted on 14 condition that the existing 47.0 feet by 11 feet loading space be 15 maintained. 16 SECTION 3: That a variance from the loading space size 1~' be granted to United Connections Inc. at 5015 Hampton Street 18 subject to the condition that the usage of the loading space be 19 limited to vehicles with a maximum length of 46 feet. 20 SECTION 4: That noncompliance with these conditions 21 shall constitute sufficient grounds for the,Ci ty Council of the 22 City of Vernon to void this variance and require the application 23 of the authorized truck loading space requirement. 24 SECTION 5: That the City Clerk of the City of Vernon 25 shall certify to the passage of this Resolution and thereupon 26 and thereafter the same shall be in full force and effect. 27 28 -2- ~. 1 APPROVED AND ADOPTED THIS 13TH day of December 1988. 2 3 ~~~. 4 ATTEST [) d-~ BRUCE V.
