MEATS FROM THE AMENDED INTERIM ZONING ORDINANCE, SECTION 4.2.8, DEVELOPMENT STANDARDS, FOR PROPERTY LOCATED AT 3111 44TH STREET IN THE CITY OF VERNON WHEREAS, D.J. Meats has applied for an occupancy permit for a building which requires a variance from the Amended Interim Zoning Ordinance, Section 4.2.8, Development Standards, for property located at 3111 44th Street; and WHEREAS, the physical condition of the property is unique in that the existing 5,000 square foot building was con- structed with a truck dock measuring 60.0 feet from the street right-of-way and 41 feet wide; and WHEREAS, Interim Zoning Ordinance Section 4.2.7 requires one loading space for a building under 8,000 square feet in floor area, Section 4.2.8c specifies that each loading space shall be a minimum of 20-feet wide and 65 feet long and Section 4.4.4c provides that a non-conforming building must comply with these standards with any changes in occupancy unless a variance is granted; and WHEREAS, the application of the development standards for truck loading space sizing requirements will ,create an unrea- sonable hardship by requiring that a 65 ;feet long by 20 feet wide space be provided; and WHEREAS, D.J. Meats has indicated that they have no plans to expand or alter the building configuration and that the 41 feet wide by 60 feet long loading space is sufficient for the use intended; and 1 WHEREAS, 3111 44th Street is located in the M zone 2 and their operation is consistent with the objectives of the 3 General Plan and Zoning Ordinance; and 4 WHEREAS, the city Council, of the City of Vernon held a 5 hearing on said application for a variance on December 13, 1988. 6 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 7 THE CITY OF VERNON AS FOLLOWS: 8 SECTION 1: That the City Council of the City of Vernon 9 hereby finds and determines that the recitals contained hereinabove 10 are true and correct. 11 SECTION 2: That a variance from the requirement for a 12 loading space 20-feet wide by 65-feet long be granted onoondition 13 that the existing 60 feet by 41 feet loading space be maintained. 14 SECTION 3: That a variance from the loading space size 15 be granted to D.J. Meats at 3111 44th Street subject to these 16 conditions: the usage of the loading space be limited to vehicles 1~' with a maximum length of 59 feet, parking be provided as shown on 18 the plot plan submitted with the variance application, and a 30" 19 high masonary wall be constructed along the full frontage where 20 parking areas adjoin a public street, except at driveways. 21 SECTION 4: That noncompliance with these conditions 22 shall constitute sufficient grounds for the City Council of the 23 City of Vernon to void this variance and require the application 24 of the authorized truck loading space requirement. 25 SECTION 5: That the City Clerk of the City of Vernon 26 shall certify to the passage of this Resolution and thereupon 27 and thereafter the same shall be in full force and effect. 28 -2- 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 1 2 3 4 ATTEST 5 /?
