1 RESOLUTION NO. ~
2 A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
3 PERMIT TO A-1 EXPRESS DELIVERY SERVICE, INC.
FOR THE OPERATION OF A TRUCK TERMINAL AT
4 4520 MAY WOOD AVENUE IN THE CITY OF VERNON
5 WHEREAS, A-1 Express Delivery Service, Inc.
6 has applied for a conditional use permit to operate a
7 truck terminal at 4520 Maywood Avenue:
8 WHEREAS, the City Council of the City of Vernon
9 held a hearing on said application for a conditional use
10 permit on February 7, 1989; and
11 WHEREAS, the proposed use is a non conforming
12 use which may be continued pursuant to Section 4.4.1 of
13 the Amended Interim Comprehensive Zoning Ordinance as
14 adopted on May 17, 1988; and
15 WHEREAS, the proposed site has been continuously
16 used as a truck terminal and required a conditional use
17 permit under the 1975 Zoning Ordinance; and
18 WHEREAS, the proposed site is approximately 1.97
19 acres and is of adequate size and shape for the proposed
20 operation; and
21 WHEREAS, the proposed site is surrounded by in-
22 dustrial uses compatible with the proposed use and no ad-
23 verse noise, odor, dust, smoke, light or glare, or risk of
24 fire, infection or explosion is anticipated from the
25 proposed operation; and
26 WHEREAS, the site has access to Maywood Avenue
27 (80 feet wide) and will have access to Exchange Avenue
28 (planned to be 60 feet wide) which are both of adequate

1 size and construction to handle the existing traffic gen-
2 erated from the proposed operation; and
3 WHEREAS, There are no conditions imposed by
4 State or Federal laws; and
5 WHEREAS, the conditions imposed on the condi-
6 tional use permit will adequately protect the public
7 health, safety and general welfare and the operation is
8 consistent with all applicable rules and laws of the
9 City of Vernon; and
10 WHEREAS, the proposed use as a continuing non-
11 conforming use is consistent with the proposed General
12 Plan and the Amended Interim Comprehensive Zoning Or-
13 dinance of the City of Vernon; and
14 WHEREAS, the site will combine two parcels of
15 real property, the truck terminal belonging to Richard W.
16 Parker and Joyce E. Parker, and a strip of land 16.5 feet
17 wide adjoining Exchange Avenue and owned by the
18 L.A. Junction Railway.
19 NOW, THEREFORE, BE IT RESOLVED BY THE CITY
20 COUNCIL OF THE CITY OF VERNON AS FOLLOWS:
21 SECTION 1: That the City Council of the City
22 of Vernon hereby finds and determines that the recitals
23 contained hereinabove are true and correct.
24 SECTION 2: That the conditional use permit to
25 A-1 Express Delivery Service, Inc., for the operation
26 of a truck terminal at 4520 Maywood Avenue be granted.
27 SECTION 3: _In order to adequately protect the
28 public health, safety and general welfare the following

1 conditions are imposed:
2 a) After the applicant has acquired title to
3 both parcels of real property, a lot line adjustment shall
4 be processed through the Community Services Department of
5 the City of Vernon in order to merge the parcels. This
6 merger shall be completed by May 1, 1989, unless said time
7 limit is extended in writing by the Los Angeles Junction
8 Railway.
9 b) The northerly 14.5 foot portion of the rail
10 road right-of-way shall be deeded to the City of Vernon
11 and a 10 foot sidewalk, curb, gutter, driveway and pave-
12 ment shall be constructed upon the deeded property.
13 c) Sufficient land shall be deeded to the City
14 of Vernon and a 50 foot curb return with a 10 foot
15 sidewalk shall be constructed at the southeast corner of
16 Maywood Avenue and Exchange Avenue.
17 d) The steps encroaching in Maywood Avenue
18 shall be removed.
19 e) Curb, gutter, sidewalk and driveway shall be
20 constructed along the Maywood Avenue frontage.
21 f) Where parking areas adjoin a public street
22 a masonry wall not less than 30 inches in height shall be
23 constructed, except at driveways, walkways or where other
24 openings are necessary.
25 g) All parking, loading and maneuvering
26 requirements for the facility shall meet the City Zoning
27 Ordinance.
28 h) The facility shall be operated in accordance

with the appropriate codes, rules, regulations and permit
fees as adopted by the City of Vernon.
i) Any hazardous substances used or handled
shall have prior approval from Vernon Fire and Health
Departments.
j) Trucks using the docks facing Exchange
Avenue shall be limited to a maximum length of 32 feet.
SECTION 4:
The City Clerk of the City of Ver-
non shall certify to the passage of this resolution and
thereupon and thereafter the same shall be in full force
and effect,
