RESOLUTION NO. 5600 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON PROHIBITING THE DISCLOSURE OF DATA AND INFORMATION GATHERED BY THE CITY FROM UTILITY CUSTOMERS AND BUSINESSES FOR PLANNING PURPOSES WHEREAS, the Department of Water and Power for the City of Vernon conducts surveys of utility customers for pur- poses of planning future growth and in order to advise cus- tomers on energy and water conservation; and WHEREAS, other departments from time to time find it necessary to gather information from businesses and industry for planning and advisory purposes; and WHEREAS, utility customers, businesses and industry have expressed concern about the confidentiality of such sur- veys and other information gathered for the use of the City of Vernon's departments, and have requested assurance that such materials shall be treated confidentially; and WHEREAS, Section 6254 of the Government Code of the State of California provides that certain public records are exempt from pUblic disclosure, including, but not limited to, "Geological and geophysical data, plant production data, and similar information relating to utility systems development, or market or crop reports, which are obtained in confidence from any person"; and WHEREAS, Government Code, Section 6254.5 provides that the exempt status of such public records may be lost, if they are disclosed to any member of the public, unless the dis- closure of such records is: III 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ~ .' "(d) Not required by law, and prohibited by formal action of an elected legisla- ti ve body of the local agency which retains the writings. (e) Made to any governmental agency which agrees to treat the disclosed material as confidential. only persons authorized in writing by the person in charge of the agency shall be permitted to obtain the information. Any informa- tion obtained by the agency shall only be used for purposes which are consistent with existing law." NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the city of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: Any records, including, but not limited to data, information, reports, surveys, studies, estimates, evaluations, and statements of any kind, which are gathered by any department of the City of Vernon, shall be obtained in confidence, if such records are exempt from disclosure as a pUblic record, pursuant to Government Code, Section 6250, et. seq. , SECTION 3: The disclosure of any such record, except as required by law, or made pursuant to the provisions of Government Code, Section 6254.5, shall be and is prohibited. 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 4: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect.
