RESOLUTION NO. 5602 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO CON-WAY WESTERN EXPRESS, INC. FOR THE OPERATION OF A TRUCK TERMINAL AT 2910 ROSS STREET WHEREAS, Con-Way Western Express, Inc. has applied for a conditional use permit to operate a truck terminal at 2910 Ross Street; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a conditional use permit on March 7, 1989; and WHEREAS, the proposed use is a non conforming use which may be continued pursuant to Section 4.4.1 of the Amended Interim Comprehensive Zoning Ordinance as adopted on May 17, 1988; and WHEREAS, the proposed site has been continuously used as a truck terminal and required a conditional use permit under the Zoning Code which was in effect at the time the application was filed; and WHEREAS, the proposed site is approximately 4.8 acres and is of adequate size and shape for the proposed operation; and WHEREAS, the proposed site is surrounded by in- dustrial uses compatible with the proposed use and no ad- verse noise, odor, dust, smoke, light or glare, or risk of fire, infection or explosion is anticipated from the III III 1 1 proposed operation; and 2 WHEREAS, the site has access to Ross Street (60 3 feet wide), and trucks will travel from the site on Ross 4 Street to Alameda Street or 38th Street, using these 5 streets to exit the City. All these streets are of 6 adequate size to handle the traffic generated from the 7 proposed operations; 8 and 9 WHEREAS, There are no conditions imposed by 10 State or Federal laws; and 11 WHEREAS, the conditions imposed on the condi- 12 tional use permit will adequately protect the public 13 health, safety and general welfare and the operation is 14 consistent with all applicable rules and laws of the 15 City of Vernon; and 16 WHEREAS, the proposed use as a continuing non- 17 conforming use is consistent with the proposed General 18 Plan and the Interim Comprehensive Zoning Ordinance of the 19 City of Vernon. 20 NOW, THEREFORE, BE IT RESOLVED BY THE CITY 21 COUNCIL OF THE CITY OF VERNON AS FOLLOWS: 22 SECTION 1: That the City Council of the City 23 of Vernon hereby finds and determines that the recitals 24 contained hereinabove are true and correct. 25 SECTION 2: That the conditional use permit to 26 Con-Way Western Express, Inc., for the operation of a 2~ III 28 III 2 1 truck terminal at 2910 Ross Street be granted. 2 SECTION 3: _In order to adequately protect the 3 public health, safety and general welfare the following 4 conditions are imposed: 5 a) The facility shall be operated in accordance 6 with the appropriate codes, rules, regulations and permit 7 fees as adopted by the City of Vernon. 8 b) Any hazardous substances used or handled 9 shall have prior approval from the Vernon Fire and Health 10 Departments. 11 c) The number of employee parking spaces 12 required per Vernon City Code shall be provided and main- 13 tained. 14 d) The truck and trailer storage and parking 15 plan shall be approved by the Director of Community Serv- 16 ices and the Fire Chief prior to occupancy. All parking 17 and loading facilities shall be paved with a hard, durable 18 surface material and shall be adequately drained, and kept 19 free of dust, mud, trash or weeds. All unpaved areas 20 where underground tanks or contaminated soil are being 21 removed or stored must be isolated from parking, loading 22 or maneuvering areas as approved by the Director of 23 Community Services. 24 e) Where parking areas adjoin a public street 25 or streets, a masonry wall not less than 30 inches in 26 height or landscaped area a minimum of 4 feet in width, 23 III 28 III 3 . . 1 measured from the property line, shall be established 2 along such full frontage, except at driveways, walkways or 3 where other openings are necessary. 4 f) Servicing of vehicles including washing, 5 steam cleaning and repairing, shall be prohibited until 6 proper facilities are constructed for such work. 7 g) All underground tanks shall be made to con- 8 form with all present City Codes. Existing tank product 9 piping shall be replaced with double wall piping, monitor- 10 ing system and tank testing shall be certified and an 11 impervious surface shall be constructed and maintained 12 over the tanks and around the fueling island. Plans and a 13 timetable for such work shall be submitted and approved 14 by the appropriate City Departments prior to occupancy 15 h) The fire hydrant on the east side of the 16 property shall be repaired. All fire hydrants shall be 17 maintained and operable at all times. 18 i) All contaminated soil shall be removed 19 from the site subject to the inspection and approval of 20 the Health Officer. 21 SECTION 4: The City Clerk of the City of Vernon 22 shall certify to the passage of this resolution and there- 23 upon and thereafter the same shall be in full force and 24 effect. 25 III 26 III 2.f III 28 III 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 2fi 28 , .
