A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON DETERMINING THE INDUSTRIAL
DISABILITY RETIREMENT OF RAY L. GROOM, A
LOCAL MISCELLANEOUS MEMBER EMPLOYED BY THE
CITY OF VERNON (Government Code Sections
21024 and 21025)

WHEREAS, the City of Vernon (hereinafter referred to as
"Vernon") is a contracting agency of the Public Employees
Retirement System; and
WHEREAS, by this Resolution, Vernon is hereby filing an

application for the disability retirement of RAY L. GROOM
employed by Vernon in the position of utilityroan in the Vernon
Water Department; and

WHEREAS, by letter dated April 17, 1989, Bruce V.
Malkenhorst, the City AdministratorlCity Clerk, notified RAY L.
GROOM that a hearing to consider the disability retirement issue

was scheduled for May 2, 1989, in the City Council Chambers at
the City Hall at 5:00 p.m. and that documentation respecting
said issue was to be submitted to the City Clerk on or before
1:00 p.m. on April 27, 1989; and
WHEREAS, the City Council of the City of Vernon has
reviewed the medical and other evidence relevant to such alleged
disability; and

WHEREAS, such lIindustrialll disability was not caused by

third party liability.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF

THE CITY OF VERNON AS FOLLOWS:

SECTION 1: That the City Council of the city of Vernon
hereby finds and determines that RAY L. GROOM is incapacitated

within the meaning of the Public Employees' Retirement Law from
the performance of his duties in the position of utilityroan in
the Vernon Water Department.
SECTION 2: That the City Council of the City of Vernon

hereby determines from the reports of Dr. Charles Glatstein that
RAY L. GROOM is unable to substantially perform the duties of
his position as a utilityroan and therefor should be retired.

SECTION 3: The City Clerk of the City of Vernon shall
certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.
APPROVED AND ADOPTED this 2nd day of May, 1989.
