RESOLUTION NO. 5617
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO BAY AREA - LOS ANGELES EXPRESS,
INC. FOR THE OPERATION OF A TRUCK TERMINAL
AT 1799 INDUSTRIAL WAY
WHEREAS, Bay Area - Los Angeles Express, Inc.
has applied for a conditional use permit to operate a
truck terminal at 1799 Industrial Way; and
WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a conditional use
permit on May 16, 1989; and
WHEREAS, the proposed site has been con-
tinuously used as a truck terminal and required a condi-
tional use permit under the Zoning Ordinance which was in
effect at the time the application was filed; and
WHEREAS, the proposed site is approximately 2.9
acres and is adequate in size, shape and topography for
the proposed operation, has adequate drainage, and
landscaping if required will be installed pursuant to the
Vernon City Code; and
WHEREAS, the proposed site is surrounded by
industrial uses compatible with the proposed use and no
adverse effect from traffic, parking, noise, odors, dust,
smoke, light or glare, or risk of fire, infection or ex-
plosion is anticipated from the proposed operation; and
WHEREAS, the site has access to Industrial Way,
and traffic will travel from the site on Industrial Way
28 to either Grande Vista, or Washington Boulevard. All of

1 said streets are located in the City of Los Angeles and
2 are of adequate width and pavement type to handle the
3 traffic generated from the proposed operations; and
4 WHEREAS, the site is required to have adequate
5 off-street parking and loading facilities in accordance
6 with the Vernon City Code; and
7 WHEREAS, there are no conditions imposed by
8 State or Federal laws; and
9 WHEREAS, the conditions imposed on the condi-
10 tional use permit will adequately protect the public
11 health, safety and general welfare and the operation is
12 consistent with all applicable rules and laws of the City
13 of Vernon; and
14 WHEREAS, the proposed use as to location,
15 operation, and design is consistent with the General Plan
16 and the Zoning Ordinance of the City of Vernon.
17 NOW, THEREFORE, BE IT RESOLVED BY THE CITY
18 COUNCIL OF THE CITY OF VERNON AS FOLLOWS:
19 SECTION 1: The City Council of the City
20 of Vernon hereby finds and determines that the recitals
21 contained hereinabove are true and correct.
22 SECTION 2: The conditional use permit to
23 Bay Area - Los Angeles Express, Inc. for the operation of
24 a truck terminal at 1799 Industrial Way is granted.
25 SECTION 3: In order to adequately protect the
26 public health, safety and general welfare the following
27 conditions are imposed:
28 a) The facility shall be operated in accord-

1 ance with the appropriate codes, rules, regulations and
2 subject to permit fees as adopted by the City of Vernon.
3 Prior to occupancy a business license and occupancy per-
4 mit shall be obtained.
5 b) Any hazardous substances used or handled
6 shall have prior approval from the Vernon Fire and Health
7 Departments.
8 c) The number of employee parking spaces
9 required per Vernon City Code shall be provided and main-
10 tained.
11 d) All parking and loading facilities shall
12 be paved with a hard, durable surface material and shall
13 be adequately drained, and kept free of dust, mud, trash
14 or weeds.
15 e) Where parking areas adjoin a public street
16 or streets, a masonry wall not less than 30 inches in
17 height or landscaped area a minimum of 4 feet in width,
18 measured from the property line, shall be established
19 along such frontage, except at driveways, walkways or
20 where other openings are necessary.
21 f) Servicing of vehicles including washing,
22 steam cleaning and repairing shall be performed in
23 facilities in compliance with appropriate codes.
24 g) All underground tanks shall be made to
25 conform with all present City Codes.
26 h) Frontage improvements on Downey Road fron-
27 tage road shall be constructed per City standards.

SECTION 4: The City Clerk of the City of Ver-

1 non shall certify to the passage of this resolution and
2 thereupon and thereafter the same shall be in full force
3 and effect.
4 APPROVED AND ADOPTED this 16th day of May, 1989
