RESOLUTION NO. 5629
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON AUTHORIZING THE SALE OF
CONFISCATED WEAPONS BY THE POLICE
DEPARTMENT
WHEREAS, the City of Vernon Police Department during
the course of investigating criminal acti vi ty has accumulated
more than 100 pistols, rifles, and shotguns which have been
confiscated from suspects; and
WHEREAS, section 12028 of the Penal Code of the state
of California authorizes the Chief of Police to sell at auction
any legal weapons with commercial value to "persons licensed
under federal law to engage in business invol ving any weapon
purchased"; and
WHEREAS, Penal Code section 12028 authorizes the Chief
of Police to destroy any weapons which are "not of the type that
can be sold to the public,
generally" or which have no
commercial value, or in the alternative Penal Code section 12030
authorizes the Chief of Police to turn the weapons over to
specified agencies; and
WHEREAS, Penal Code section 12030 requires that any
weapon retained by the agency or destroyed be reported to the
Department of Justice; and
WHEREAS, the Chief of Police has recommended that
approximately ten of the weapons be destroyed and that the rest
be sold at public auction to authorized dealers.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon

hereby finds and determines that the recitals contained
hereinabove are true and correct.
SECTION 2: The City council of the City of Vernon
hereby approves the sale andlor destruction of the confiscated
weapons subject to the provisions of Penal Code Section 12028
and 12030.
SECTION 3: The City Clerk of the City of Vernon shall
certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.
