RESOLUTION NO. 5652
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL
USE PERMIT TO UINTAH FREIGHTWAYS, INC.
FOR THE OPERATION OF A TRUCK TERMINAL
AT 4366 26TH STREET
WHEREAS, Uintah Freightways, Inc. has applied
for a conditional use permit to operate a truck terminal
at 4366 26th Street; and
WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a conditional use
permit on August 8, 1989; and
WHEREAS, the proposed site has been con-
tinuously used as a truck terminal and required a condi-
tional use permit under the Zoning Ordinance which was in
effect at the time the application was filed; and
WHEREAS, the proposed site is approximately 2.0
acres and is adequate in size, shape and topography for
the proposed operation, has adequate drainage, and
landscaping if required will be installed pursuant to the
Vernon City Code; and
WHEREAS, the proposed site is surrounded by
industrial uses compatible with the proposed use and no
adverse effect from traffic, parking, noise, odors, dust,
smoke, light or glare, or risk of fire, infection or ex-
plosion is anticipated from the proposed operation; and
WHEREAS, the site has access to 26th Street
and traffic will travel from the site on 26th Street
to Bonnie Beach Place, south to Bandini Boulevard, then

1 east or west to freeway access. All of said streets are
2 located in the City of Vernon and are of adequate width
3 and pavement type to handle the traffic generated from
4 the proposed operations; and
5 WHEREAS, the site is required to have adequate
6 off-street parking and loading facilities in accordance
7 with the Vernon City Code; and
8 WHEREAS, there are no conditions imposed by
9 State or Federal laws; and
10 WHEREAS, the conditions imposed on the condi-
11 tional use permit will adequately protect the public
12 health, safety and general welfare and the operation is
13 consistent with all applicable rules and laws of the City
14 of Vernon; and
15 WHEREAS, the proposed use as to location,
16 operation, and design is consistent with the General Plan
17 and the Zoning Ordinance of the City of Vernon.
18 NOW, THEREFORE, BE IT RESOLVED BY THE CITY
19 COUNCIL OF THE CITY OF VERNON AS FOLLOWS:
20 SECTION 1: The City Council of the City
21 of Vernon hereby finds and determines that the recitals
22 contained hereinabove are true and correct.
23 SECTION 2: The conditional use permit to
24 Uintah Freightways, Inc. for the operation of a truck
25 terminal at 4366 26th Street is granted.
26 SECTION 3: In order to adequately protect the
27 public health, safety and general welfare the following
28 conditions are imposed:

1 a) The facility shall be operated in accord-
2 ance with the appropriate codes, rules, regulations and
3 subject to permit fees as adopted by the City of Vernon.
4 Prior to occupancy a business license and occupancy per-
5 mit shall be obtained.
6 b) Any hazardous substances used, handled or
7 stored shall have prior approval from the Vernon Fire and
8 Health Departments.
9 c) The number of employee parking spaces
10 required per Vernon City Code shall be provided and main-
11 tained.
12 d) All parking and loading facilities shall
13 be paved with a hard durable surface material and shall
14 be adequately drained, and kept free of dust, mud, trash
15 or weeds.
16 e) Where parking areas adjoin a public street
17 or streets, a masonry wall not less than 30 inches in
18 height or landscaped area a minimum of 4 feet in width,
19 measured from the property line, shall be established
20 along such frontage, except at driveways, walkways or
21 where other openings are necessary.
22 f) Servicing of vehicles including washing,
23 steam cleaning and repairing shall be performed in
24 facilities in compliance with appropriate codes.
25 g) Underground storage tank monitoring system
26 shall be checked by a qualified service person. Monitor-
27 ing system must meet requirements of Vernon City Or-
28 dinance No. 944.

h)
Frontage improvements shall be constructed
2 along 26th Street adjacent to Uintah Freightways site.
3 This work shall include new sidewalk, curb, gutter,
4 asphalt and any other improvements required to bring said
5 frontage to City standard. All work shall be performed
6 under an encroachment permit from the City.
7 SECTION 4: The City Clerk of the City of Ver-
8 non shall certify to the passage of this resolution and
9 thereupon and thereafter the same shall be in full force
10 and effect.
