1 RESOLUTION NO. 5666
2 A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON APPROVING AND AUTHORIZING
3 THE EXECUTION OF A 1989-1990 AMENDED
IN-LIEU REPLENISHMENT AGREEMENT (WHICH
4 INCLUDES PROVISIONS FOR THE USE OF LONG
TERM SEASONAL STORAGE) BY AND BETWEEN THE
5 CITY OF VERNON AND THE CENTRAL AND WEST
BASIN WATER REPLENISHMENT DISTRICT

7 WHEREAS, the Central Basin Municipal Water District is
8 a member agency of the Metropolitan Water District; and
9 WHEREAS, the Central and West Basin Water Replenishment
10 District was formed to carry out replenishment functions; and
11 WHEREAS, the City of Vernon purchases water from the
12 Central Basin Municipal Water District; and
13 WHEREAS, the Metropolitan Water District has adopted
14 a program whereby "water producers" of member agencies may pur-
15 chase water on a restricted basis during specific months at an
16 "in-lieu" replenishment rate; and
17 WHEREAS, the City Council of the City of Vernon
18 adopted Resolution No. 5630 on June 20, 1989, which approved the
19 execution of the 1989-1990 In-Lieu Replenishment Agreement; and
20 WHEREAS, Bruce V. Malkenhorst, the City Administrator/
21 City Clerk, has recommended that the City Council approve the
22 1989-1990 In-Lieu Replenishment Agreement by letter dated
23 August 29, 1989.
24 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
25 OF THE CITY OF VERNON AS FOLLOWS:

SECTION 1: That the City Council of the City of
27 Vernon hereby finds and determines that the recitals contained
28 hereinabove are true and correct.

SECTION 2: That the City Council of the City of
2 Vernon hereby approves the 1989-1990 Amended In-Lieu
3 Replenishment Agreement, a copy of which has been presented to
4 the City Council concurrently with this resolution, and the
5 City Council hereby orders said Agreement to be received and
6 filed by the City Clerk.

SECTION 3: That the City Council of the City of
8 Vernon hereby authorizes the Mayor and the City Clerk to execute
9 said Agreement for, and on behalf of, the City of Vernon.
10
SECTION 4: The City Clerk of the City of Vernon
11 shall certify to the passage of this resolution and thereupon
12 and thereafter the same shall be in full force and effect.
13 APPROVED AND ADOPTED this 5th day of September, 1989.
