RESOLUTION NO. 5670

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON APPROVING AND AUTHORIZING
THE EXECUTION OF A SPECIAL USE PERMIT
BETWEEN THE CITY OF VERNON AND THE FOREST
SERVICE, U. S . DEPARTMENT OF AGRICULTURE,
RESPECTING PROPOSED BEAR BUTTE HYDRO-
ELECTRIC PROJECT NON-GROUND DISTURBING
FIELD STUDIES

WHEREAS, the Forest Service, U. S. Department of
8 Agriculture ("USFS") requires the execution of a Special Use
9 Permit and the deposit of fees for proposed Bear Butte
10 Hydroelectric Project non-ground disturbing field studies; and
11
WHEREAS, the City Council of the City of Vernon wishes
12 to enter into a Special Use Permit with the USFS for the purpose
13 of conducting non-ground disturbing feasibility studies, data
14 gathering and cadastral surveying in conjunction with the
15 proposed Bear Butte Hydroelectric Project.
l6 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
l7 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon
19 hereby finds and determines that the recitals contained
hereinabove are true and correct.

SECTION 2: The City Council of the city of Vernon
22 hereby approves the Special Use Permit, a copy of which has been
23 presented to the City Council concurrently with this resolution
24 and the City Council hereby orders said Permit to be received
25 and filed by the City Clerk.

SECTION 3: The City Council of the City of Vernon
27 hereby authorizes the Mayor to execute said Permit for, and on
28 behalf of, the City of Vernon and instructs the City Clerk to

return the same with the necessary fees to the USFS.

SECTION 4: The City Clerk of the City of Vernon shall

certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.
