Resolution No. 5690 . 1 2 RESOLUTION NO. 5690 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF SUPPLEMENT NO. 004 TO LOCAL AGENCY-STATE MASTER AGREEMENT NO. 07-5139 3 4 5 6 WHEREAS, the State of California and the City of Vernon entered into a Local Agency-State Master Agreement No. 07-5139 for Federal Aid on August 7, 1979; and 7 8 WHEREAS, the Public utilities commission has 9 10 11 recommended that the protection at the crossing on 28th Street just east of Santa Fe Avenue be improved from a wig wag signal to number 9 gates with lights and the City of Vernon is eligible to receive Federal funding for this project; and WHEREAS, the City of Vernon desires to enter into a supplement to said Master Agreement to cover Federal Aid Safety Funds in the City of Vernon for Railroad Protection at the 12 13 14 15 16 crossing on 28th Street just east of Santa Fe Avenue; and 17 18 WHEREAS, the estimated total cost of the improvement is $89,000, with the City'S share being $8,900, which is being paid by Roadway Package System as a condition of their conditional 19 20 21 use permit. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 22 THE CITY OF VERNON AS FOLLOWS: 23 24 SECTION 1: The City Council of the City of Vernon finds and determines hereby recitals contained that the 25 26 27 28 hereinabove are true and correct. III /11 1/1 <. 1 2 SECTION 2: The City Council of the City of Vernon hereby approves Supplement No. 004 to Local Agency-State Master 3 Agreement No. 07-5139, a copy of which has been presented to the City Council concurrently with this resolution and the City Council hereby orders said Agreement to be received and filed by 4 5 6 the City Clerk. 7 SECTION 3: The City Council of the City of Vernon hereby authorizes the Mayor and the City Clerk to execute said 8 9 Agreement for, and on behalf of, the City of Vernon. 10 11 SECTION 4: The City AdministratorlCity Clerk is hereby instructed to return two executed copies of the supplement No. 12 13 004 together with a certified copy of this resolution to W.B. Ballantine, Chief, Local Streets and Roads Branch, Department of 14 Transportation, District 7, 120 S. Spring st., Los Angeles, CA 15 16 90012. The cost of maintenance of the crossing shall be as allocated by Public utilities commission. 2. All required pavement marking and advance warning signs shall comform to the requirements of MUTCD, 1978 and shall be placed in their proper location by the Local Agency at the time of completion of the Railroad's work. 3. The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2)/Detail Estimate, or its modification (PR-2A) or the FNM-76, and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Division of Local Streets and Roads. 4. In executing this Program supplemental Agreement, Local Agency hereby reaffirms the 'Nondiscrimination Assurances' contained in the aforementioned Master Agreement for Federal-Aid Program. This supplement covers Federal Aid Safety Funds in the City of Vernon for Railroad Protection at-the cross- ing on 28th Street just east of Santa Fe Avenue. The Public Utilities Commission has recommended that the protection at this crossing be improved from a wig wag signal to number 9 gates with lights. The City is eligible to receive Federal funding for this project. The estimated cost is $89,000 for the improvement. Per this agreement they will contribute $80,100, leaving $8,900 as the City's share. The City has made it a conditian of Roadway Package System, Inc.'s conditional use permit to pay the City of Vernon's por- tion. Roadway has deposited $15,000 with the City. Therefore, it is recommended that the City Council take ac- tion to authorize the City Clerk to execute the Supplemental Agreement.
