Resolution No. 5702 1 RESOLUTION NO. 5702 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ACCEPTING THE BID OF 3 SHAWNAN CORPORATION, FOR PACKERS, C.M.D. SEWER, STORM DRAIN AND STREET RECONSTRUCTION 4 IN ACCORDANCE WITH CONTRACT NO. 497 OF THE CITY OF VERNON AND APPROVING THE EXECUTION 5 OF SAID CONTRACT. 6 WHEREAS, Contract No. 497 of the City of Vernon was 7 approved by the City Council of the City of Vernon pursuant to 8 Resolution No. 5694, and sealed bids were opened on Wednesday, 9 December 27, 1989; and 10 WHEREAS, said bids were referred to Victor H. Vaits, 11 Director of Community Services, who has reported to the City 12 Council under the date of December 28, 1989, recommending that 13 Contract No. 497 for Packers, C.M.D. Sewer, Storm Drain and 14 street Reconstruction, be executed with SHAWNAN CORPORATION 15 on the basis of its bid in the sum of One Million Two Hundred 16 Thirty-six Thousand One Hundred Thirty-seven Dollars 17 {$1,236,137.00}, being the lowest responsible bid meeting the 18 contract requirements. 19 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL 20 OF THE CITY OF VERNON AS FOLLOWS: 21 SECTION 1: The City Council of the City of Vernon 22 hereby finds and determines that the recitals contained 23 hereinabove are true and correct. 24 SECTION 2: The City Council of the City of Vernon 25 does hereby award Contract No. 497 to SHAWNAN CORPORATION, 26 in accordance with the recommendation of Victor H. RECITALS The City of Vernon requires frontage improvements to Loma Vista Avenue, 48th Street, 49th Street and Corona Avenue, Vernon, California, per the Building Permit Numbers 5.8530 , 58531 and 58532. AGREEMENT NOW, THEREFORE, in consideration of the premises and the promises: hereinafter set forth, the parties-agree as follows: FLRST: Vernon shall construct certain public improvements- on Loma Vista Avenue, 48th Street, 49th Street and Corona Avenue, in the City of Vernon, California, as more particularly described in Exhibit "A" attached hereto. ..Santa- Fe shall pay to Vernon the actual cost of a portion of those improvements which are more particularly described in Exhibit "B" attached hereto. Santa Fe shall deliver to Vernon concurrently with the execution of this Agreement, a-check in the amount of $600,000.00. The balance, if any, of `k the cost of such w6rk shall become payable in full when said construction is completed:. Any payment by Santa Fe in excess of actual cost of improvements shall' be refunded to Santa Fe in full when said construction is completed, Santa Fe shall have the right to review all construct-ion contracts, invoices and change orders, if any, for auditing purpose .
