Resolution No. 5722 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ 23 24 25 26 27 28 RESOLUTION NO. 5722 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO PACIFIC COLD STORAGE FROM THE COMPREHEN- SIVE ZONING ORDINANCE, SECTION 26.4.2-8, DEVELOPMENT STANDARDS, FOR PROPERTY LOCATED AT 3420 VERNON AVENUE IN THE CITY OF VERNON WHEREAS, Pacific Cold Storage owns the property at 3420 Vernon Avenue and has applied for a variance from the Comprehen- sive Zoning Ordinance, Section 26.4.2-8, Development Standards. WHEREAS, the physical condition of the property is unique in that the existing 56,954 square foot buildings were constructed with ten truck docks measuring 98.5 feet from the street right-of-way; and WHEREAS, Pacific Cold Storage is proposing to con- struct a 17,250 square foot freezer at the same site which will require an additional two new truck parking spaces to meet the combined total requirement for twelve loading and parking spaces; and WHEREAS, Pacific Cold Storage proposes to add three additional truck spaces adjacent to the ten existing spaces at the same length of 98.5 feet; and WHEREAS, all of said spaces will be in nonconformance with the Development Standards which requires a 65 foot long space with a 40 foot maneuvering area for a total length of 105 feet; and WHEREAS, 3420 Vernon Avenue is located in the M zone and the operation is consistent with the objectives of the General Plan and Zoning Ordinance; and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ 23 24 25 26 27 28 WHEREAS, the City Council, of the City of Vernon held a hearing on said application for a variance on March 6, 1990. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS; SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein- above are true and correct. SECTION 2: A variance from the requirement for a 40 foot unobstructed maneuvering area in front of the required truck parking and loading spaces is hereby granted to Pacific Cold Storage, at 3420 Vernon Avenue. SECTION 3: The variance shall be granted subject to the following conditions: (a) Los Angeles County Assessors Parcel 6303-11-46, 6303-11-32 and 6303-11-33 shall be merged. (b) Los Angeles County Assessors Parcels 6303-07-37, 6303-07- 35 shall be tied by covenant to the above newly merged lots for parking requirement purposes. (c) No on-street parking will be allowed for the subject facility. (d) The thirteen combined truck parking and loading spaces, a minimum of 98.5 feet in depth shall be maintained for the life of the building or until the buildings are altered so as not to require this number of spaces. SECTION 4: Noncompliance with these conditions shall constitute sufficient grounds for the City Council of the City of Vernon to void this variance and require the application of the authorized truck loading space requirement.
