II : '11 .. : RESOLUTION NO. 5728 1 3 4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ESTABLISHING HEALTH AND PERMIT FEES APPLICABLE TO ALL PERMITS GRANTED BY THE CITY OF VERNON PURSUANT TO SECTION 11.25, 13.7, 13.31 AND 25.12 OF THE VERNON CITY CODE AND REPEALING RESOLUTION NO. 5482 2 5 WHEREAS, the Vernon City Code and, in particular, 6 sections 11.25, 13.7, 13.31 and 25.12 thereof, provide for 7 the issuance of health permits; and 8 WHEREAS, Sections 11.25, 13.8, 13.34, and 25.12.4 9 of. the Vernon City Code provide that the City Council of the 10 City of Vernon shall establish, by resolution, health permit 11 inspection fees for the various types of businesses and 12 vehicles requiring health permits; and 13 WHEREAS, the City Council of the City of Vernon 14 adopted Resolution No. 5482 on February 16, 1988, 15 establishing health permit fees in accordance with said 16 Code; and 17 WHEREAS, said fees established by resolution are 18 hereby determined to be inadequate; and 19 WHEREAS, the City Council of the city of Vernon 20 intends to establish new fees as set forth herein. 21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL 22 OF THE CITY OF VERNON AS FOLLOWS: 23 Section 1: The City Council of the City of 24 Vernon does hereby find and determine that the recitals 25 contained hereinabove are true and correct. 26 section 2: The City Council of the City of 27 Vernon does hereby establish that the issuance fees and 28 annual renewal fees for permits granted by the City of '. 1 Vernon, pursuant to section 13.8 of the Vernon City Code 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ 23 24 25 26 27 28 shall be as follows: BUSINESS OR VEHICLE a. Caterer b. Cesspool & Sump Pumping Vehicle c. Commercial Agricultural Operation d. Food Processing Establishment (1~) Less than 2,000 sq. ft. (2.) 2,000 sq. ft. or more e. Food Vending Machine Business f. Food Warehouse g. Laundry (including vehicles operat- ing from the City of Vernon) h. Laundry Vehicle (independent and from outside the City of Vernon) i. Offal Vehicle j. Rendering Plant k. Restaurant (1.) 0-30 seats (2~) 31 seats and over 1. Retail Food Delivery Vehicle m. Retail Food Preparation Vehicle n. Retail Food Production & Marketing Establishment o. Retail Fruit & Vegetable Vehicle p. Retail Packaged Food Vehicle q. Water Supply utility $4.00 per service connection *The $90 basic inspection fee does not apply to a company operating offal vehicle(s) in conjunction with and as a part of Vernon permitted Rendering Plant or Food Processing Establishment. section 3: The City Council of the City of Vernon does hereby establish that the issuance fees, annual renewal fees and late fee penalties for health permit inspections granted by the City of Vernon pursuant to section 11.25 of the Vernon City Code shall be as follows: Wholesale Food Vehicle - $25 per vehicle section 4: The City Council of the City of Vernon does hereby establish that the issuance fees, annual renewal fees, and late fee penalties for health permit inspections granted by the City of Vernon pursuant to section 13.34 of the Vernon City Code shall be as follows: (a) Underground Hazardous sUbstances storage Facility - $190 for five (5) years; (b) Annual Tank operating Permit - $43 per tank (not to exceed $215 per facility); (c) Transfer of operating Permit - $63; (d) Amend an Operating Permit - $32; section 5: The City Council of the City of Vernon does hereby establish that the application fees, fees for filing an appeal and fees to amend a well permit granted by 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Section 25.12.4 of the Vernon City Code shall be as follows: (a) Drilling a water well or destroying or converting an existing water well - $125.00 (b) Drilling a monitoring well (ground water) - $75.00 (c) Fee for filing an appeal - $50.00 (d) Fee for amending a well permit - $25.00 Section 6: There shall be added to and collected with the permit or other fee a penalty equal to ten percent (10%) of the fee for all fees that are delinquent for thirty (30) days. For each additional month or fraction thereof in which the delinquency continues, an additional ten percent (10%) penalty shall be collected. In no event shall the penalty exceed sixty percent (60%) of the permit fee. Section 7: In addition to the foregoing, the licensee or permittee shall pay all other necessary fees or deposits which may be required by other ordinances or resolutions of the City of Vernon or applicable state laws in effect. Section 8: The fees provided for herein shall be effective April 1, 1990, and Resolution No. 5482 and all other resolutions in conflict herewith are hereby repealed.
