2 A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
3 PERMIT TO P.I.E. NATIONWIDE FOR THE
OPERATION OF A TRUCK AND FREIGHT TERMINAL
4 AT 3575 ROSS STREET
5 WHEREAS, P.I.E. Nationwide has applied for a condi-
6 tional use permit to operate a truck and freight terminal at
7 3575 Ross street; and
8 WHEREAS, the City Council of the City of Vernon held
9 a hearing on said application for a conditional use permit on
10 April 10, 1990; and
11 WHEREAS, the proposed site is a non-conforming use
12 in the General Industry (M) Zone which has been continuously
13 used as a truck and freight terminal and requires a condi-
14 tional use permit under the Zoning Ordinance in order to ex-
15 tend the use~ and
16 WHEREAS, the proposed site is adequate in size,
17 shape and topography for the proposed operation, has adequate
18 drainage, and landscaping if required will be installed
19 pursuant to the Vernon City Code; and
20 WHEREAS, the proposed site is surrounded by in-
21 dustrial uses compatible with the proposed use and no adverse
22 effect from traffic, parking noise, odors, dust, smoke, light
23 or glare, or risk of fire, infection or explosion is an-
24 ticipated from the proposed operation; and
25 WHEREAS, the site has access to Ross Street, and
26 traffic will travel from the site on Ross Street to either
27 Alameda Street or 38th Street and Bandini Boulevard. All of
28 said streets are located in the City of Vernon and are of

1 adequate width and pavement type to handle the traffic gen-
2 erated from the proposed operations; and
3 WHEREAS, the site is required to have adequate off-
4 street parking and loading facilities in accordance with the
5 Vernon City Code; and
6 WHEREAS, the conditions imposed on the conditional
7 use permit will adequately protect the public health, safety
8 and general welfare and the operation is consistent with all
9 applicable rules and laws of the City of Vernon; and
10 WHEREAS, the proposed use as to location, operation,
11 and design is consistent with the General Plan and the Zoning
12 Ordinance of the City of Vernon.
13 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
14 OF THE CITY OF VERNON AS FOLLOWS:
15 SECTION 1: The City Council of the City of Vernon
16 hereby finds and determines that the recitals contained here-
17 inabove are true and correct.
18 SECTION 2: The conditional use permit to P.I.E.
19 Nationwide for the operation of a truck and freight terminal
20 at 3575 Ross street is granted.
21 SECTION 3: In order to adequately protect the
22 public health, safety and general welfare the following
23 conditions are imposed:
24 a. The facility shall be operated in accordance
25 with the appropriate codes, rules, regulations and subject to
26 permit fees as adopted by the City of Vernon. Prior to oc-
27 cupancy a business license and occupancy permit shall be ob-
28 tained.

1 b. Any hazardous substances used or handled shall
2 have prior approval from the Vernon Fire and Health Depart-
3 ments.
4 c. The number of parking spaces required per Vernon
5 City Code shall be provided and maintained.
6 d. All parking and loading facilities shall be
7 paved with a hard, durable surface material and shall be
8 adequately drained, and kept free of dust, mud, trash or
9 weeds.
10 e. Where parking areas adjoin a public street or
11 streets, a masonry wall not less than 30 inches in height or
12 landscaped area a minimum of 4 feet in width, measured from
13 the property line, shall be established along such frontage,
14 except at driveways, walkways or where other openings are
15 necessary.
16 f. Servicing of vehicles including washing, steam
17 cleaning and repairing shall be performed in compliance with
18 appropriate codes.
19 g. A 60 foot curb return with an 8 foot wide
20 sidewalk shall be constructed on Ross street at the northeast
21 corner of the subject site. Sufficient right-of-way shall be
22 deeded to the City for this construction. All non-standard
23 driveways shall be removed and replaced with curb, gutter and
24 sidewalk. All cracked and broken sidewalk, curb or gutter
25 shall be repaired as directed by the Director of Community
26 Services.
27 h. Underground storage tank monitoring system shall
28 be checked by a qualified service person. Monitoring system

1 must meet the requirements of Vernon city Ordinance No. 944.
SECTION 4: The City Clerk of the City of Vernon
3 shall certify to the passage of this resolution and thereupon
4 and thereafter the same shall be in full force and effect.
