RESOLUTION NO. 5759
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO MCDONALDS CORPORATION FOR THE
CONSTRUCTION AND OPERATION OF A RETAIL
COMMERCIAL USE WHICH WILL GENERATE MORE
THAN 20 VEHICLE TRIPS PER DAY PER 1,000
GROSS SQUARE FEET OF FLOOR AREA
WHEREAS, McDonalds Corporation has applied for a
conditional use permit to operate a retail/commercial use
(restaurant) with a proposed floor area of approximately 4,600
square feet at 3737 Soto Street (southwest corner of Soto
Street and 37th street), on a parcel containing approximately
63,000 square feet in the General Industrial (M) Zone.
WHEREAS, the City Council of the City of Vernon held
a hearing on said application for a conditional use permit on
June 5, 1990; and
WHEREAS, the proposed use will generate more than 20
vehicle trips per day per 1,000 gross square feet of floor
area and requires a conditional use permit under Section
25.3.5-3 of the zoning code; and
WHEREAS, the proposed site is of adequate size and
shape for the proposed operation; and
WHEREAS, the proposed use is surrounded by in-
22 dustrial uses and is compatible therewith and no adverse
23 noise, odor, dust, smoke, light or glare, or risk of fire, in-
24 fection or explosion is anticipated from the proposed
25 operation; and
26 WHEREAS, the site has adequate access to Soto Street
27 and 37th Street, and it is anticipated that traffic will
28 travel to the site from all directions. 37th Street and Soto

1 Street have adequate capacity to handle the traffic generated
2 from the proposed operation; and
3 WHEREAS, there are no conditions imposed by State or
4 Federal laws; and
5 WHEREAS, the conditions imposed on the conditional
6 use permit will adequately protect the public health, safety
7 and general welfare, and the operation is consistent with all
8 applicable rules and laws of the City of Vernon; and
9 WHEREAS, the proposed use is consistent with the
10 General Plan and the Comprehensive Zoning Ordinance of the
11 City of Vernon.
12 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
13 OF THE CITY OF VERNON AS FOLLOWS:
14 SECTION 1: That the City Council of the City of
15 Vernon hereby finds and determines that the recitals contained
16 hereinabove are true and correct.
17 SECTION 2: That the conditional use permit is
18 hereby granted to McDonalds Corporation for the operation
19 of a retail/9ommercial use (restaurant) located at
20 3737 Soto Street.
21 SECTION 3: !n order to adequately protect the
22 public health, safety and general welfare the following condi-
23 tions are imposed:
24 a. The facility shall be operated in accordance
25 with the appropriate codes, rules, regulations and subject
26 to permit fees as adopted by the City of Vernon.
27 b. Pursuant to the City of Vernon Comprehensive
28 Zoning Ordinance, parking and loading spaces shall be

1 provided to accommodate the vehicles for each employee,
2 visitor and any other person normally transacting business
3 at said building. All parking and maneuvering areas, in-
4 cluding the truck ingress and egress sha 11 be paved. An
5 easement for truck ingress and egress shall be submitted and
6 approved by the City and recorded prior to the issuance of

18 shall be deposited prior to applying for any building per-
19 mits.

building permits.
c. Prior to occupancy, McDonalds shall obtain a
sales tax permit from the state Board of Equalization bear-
ing the City of Vernon Tax number 19039, and a City of Ver-
non business license.
d. McDonalds Corporation shall deposit funds in
the amount determined by the Director of Community Services
in order to construct a raised concrete median and as-
sociated re-striping in Soto street. The length of Median
and striping shall be equal to the length of frontage along
Soto Street for the subject Mcdonalds site. Said funds
e. McDonalds Corporation shall construct all fron-
tage improvements adjacent to their site along Soto street
as directed by the Director of Community Services. Plans
for the required frontage improvements will be prepared by
the City. The improvements shall include the work as-
sociated with the widening of Soto street by eight feet.
Including a new ten foot sidewalk, curb and gutter, driveway
and asphalt pavement, and the relocation of power poles,
water facilities, and traffic signals. All work shall be

1 performed to City standards and shall be completed prior to
2 occupancy. Water and power work will be performed by City
3 crews or contractors but will be funded by the owner.
4 f. Prior to the issuance of building permits
5 McDonalds Corporation, Inc. shall deed to the City of Vernon
6 the easterly eight feet of their parcel located between the
7 Dapper Tire property and the Arronson property along Soto
8 street, and J. Blak shall deed to the City the easterly
9 eight feet of their property located between 37th street and
10 the Dapper Tire property and sufficient property to con-
11 struct a sixty foot curb return at the southwest corner of
12 Soto street and 37th street. The property line radius for
13 this corner shall be fifty feet.
14 g. Adequate trash receptacles shall be provided on
15 the site to keep litter to a minimum. All McDonalds litter
16 blown or dropped on adjacent properties shall be retrieved
17 and disposed of daily by a McDonalds employee.
18 h. Any expansion or change in use shall be ap-
19 proved by the Director of Community Services.
20 i. The parking, driveway access and landscaping
21 shall be developed in accordance with the site plan which
22 was submitted with this application and approved by the
23 Director of Community Services. No changes shall be made in
24 the site development except with the prior approval of the
25 Director of Community Services.
26 SECTION 4: The City Clerk of the City of Vernon
27 shall certify to the passage of this resolution and there-
28 upon and thereafter the same shall be in full force and
