RESOLUTION NO. 5761
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON GRANTING A CONDITIONAL USE PERMIT TO
SYLVESTER FEICHTINGER FOR THE CONSTRUCTION AND
OPERATION OF A RETAIL COMMERCIAL USE WHICH WILL
GENERATE MORE THAN 20 VEHICLE TRIPS PER DAY PER
1000 GROSS> SQUARE FEET OF FLOOR AREA
WHEREAS, Sylvester Feichtinger has applied for a
conditional
use permit to operate a gas and diesel service
station,
mini.art, tire shop, and hub cap store with a proposed
area of
approximately 1650 square feet at 5475 Santa Fe
floor
10 Avenue (north"est corner of Santa Fe Avenue and 55th street).

WHEREAS, the City Council of the City of Vernon
12 held a hearing on said application for a conditional use permit

on 3une 19, 1990; and
WHEREAS, the proposed use "ill generate more than

WHEREAS, there are no conditions imposed by state
or Federal laws; and
WHEREAS, the conditions imposed on the
conditional use permit will adequately protect the publio
health, safety and general welfare, and the operation is
consistent with all applicable rules and laws of the City of
Vernon; and
WHEREAS, the proposed use is consistent with the
General Plan and the Comprehensive Zoning Ordinance of the City
of Vernon.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COUNCIL OF THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The Ci ty Counci 1 of the City of
Vernon hereby finds and determines the recitals contained
hereinabove are true and correct.
SECTION 2: A conditional use permit is hereby
granted to Sylvester Feichtinger for the operation of a gas and
diesel servioe station, minimart, tire shop and hub cap store
looated at 5475 Santa Fe Avenue.
SECTION 3: In
public health, safety and
conditions are imposed:
a. The facility shall be operated in accordance
with the appropriate oodes, rules, regulations and subject to
permit fees as adopted by the City of Vernon.

b. The number of parking and loa.dingspaces
required per the City of Vernon Comprehensive Zoning Ordinance
shall be provided. The minimum number of spaces shall
accomodate the vehicles for each employee, visitor and any
other person normally transacting business at said building.
All parking and maneuvering areas shall be paved.
c. Prior to occupancy, all vendors shall obtain
a sales tax permit form the state Board of Equalization bearing
the City of Vernon Tax number 19039, and a City of Vernon
busH ness license.
d. The owner shall engineer and construct all
frontage improvements along Santa Fe Avenue and 55th street as
directed by the Director of Community Services. The
improvement.s will include the work associated with the
enlarging of the curb return at the northwest corner of Santa
Fe Avenue and 55th Street to a 50 foot radius, including a
traffic signal and other related frontage work. The power pole
relocation will be done by the city. All work shall be
performed to City standards and shall be completed prior to
occupancy.
e. The owner shall deed to the City sufficient
property to construct a fifty foot curb return at the northwest
corner of Santa Fe Avenue and 55th Street. The property line
radius for this corner shall be forty feet.
f. Any expansion or change in use shall be
approved by the Director of Community Services.

g. Where parking areas adjoin a public street
or streets, a masonry wall not less than 30 inches.. in height or
landscaped area a minimum of 4 feet in width, measured form the
property 1 ine, shall be established along such frontage, .except
at driveways, walkways or where other openings are necessary.
h. Underground storage tank monitoring system

other person normally transacting business at said building_
All parking and maneuvering areas shall be paved. No changes
shall be made in the site development except with the prior
approval of the Director of Community Services.

SECTION 4:
The City Clerk of the City of. Vernon
shall certify to the passage of this resolution and thereupon
and thereafter the same shall be in full force and effect.
