Resolution No. 5771 1 2 3 4 5 RESOLUTION NO. 5771 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO TULLEY/TRANSRITE, INC. FOR THE OPERATION OF A TRUCK AND FREIGHT TERMINAL AT 4415 BANDINI BOULEVARD 6 WHEREAS, Tulley/Transrite, Inc. has applied for a 7 conditional use permit to operate a truck and freight terminal 8 at 4415 Bandini Boulevard; and 9 WHEREAS, the City Council of the City of Vernon held 10 a hearing on said application for a conditional use permit on 11 June 19, 1990; and 12 WHEREAS, the proposed site is a conforming use 13 in the Heavy Industry (M-2) Zone which has been continuously 14 used as a truck and freight terminal and requires a condi- 15 tional use permit under the Zoning Ordinance; and 16 WHEREAS, the proposed site is adequate in size, 17 shape and topography for the proposed operation, has adequate 18 drainage, and landscaping if required will be installed 19 pursuant to the Vernon City Code; and 20 WHEREAS, the proposed site is surrounded by in- 21 dustrial uses compatible with the proposed use and no adverse 22 effect from traffic, parking noise, odors, dust, smoke, light 23 or glare, or risk of fire, infection or explosion is an- 24 ticipated from the proposed operation; and 25 WHEREAS, the site has access to Bandini Boulevard, 26 and traffic will travel from the site on Bandini Soulevard to 27 either Atlantic Boulevard or the Long Beach Freeway. All of 28 said streets are located in the City of Vernon and are of 1 1 adequate width and pavement type to handle the traffic gen- 2 erated from the proposed operations; and 3 WHEREAS, the site is required to have adequate off- 4 street parking and loading facilities in accordance with the 5 Vernon City Code; and 6 WHEREAS, the conditions imposed on the conditional 7 use permit will adequately protect the public health, safety 8 and general welfare and the operation is consistent with all 9 applicable rules and laws of the City of Vernon; and 10 WHEREAS, the proposed use as to location, operation, 11 and design is consistent with the General Plan and the Zoning 12 Ordinance of the City of Vernon. 13 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL 14 OF THE CITY OF VERNON AS FOLLOWS: 15 SECTION 1: The City Council of the City of Vernon 16 hereby finds and determines that the recitals contained here- 17 inabove are true and correct. 18 SECTION 2: The conditional use permit to 19 Tulley/Transrite, Inc. for the operation of a truck and 20 freight terminal at 4415 Bandini Boulevard is granted. 21 SECTION 3: In order to adequately protect the 22 public health, safety and general welfare the following 23 conditions are imposed: 24 a. The facility shall be operated in accordance 25 with the appropriate codes, rules, regulations and subject to 26 permit fees as adopted by the City of Vernon. Prior to oc- 27 cupancy a business license and occupancy permit shall be ob- 28 tained. 2 1 b. Any hazardous materials used handled, or stored 2 shall have prior approval from the Vernon Fire and Health 3 Departments. 4 c. The number of parking spaces required per Ver- 5 non City Code shall be provided and maintained. 6 d. All parking and loading facilities shall be 7 paved with a hard durable surface material and shall be 8 adequately drained, and kept free of dust, mud, trash or 9 weeds. 10 e. Servicing of vehicles including washing, steam 11 cleaning and repairing shall be prohibited unless performed in 12 compliance with appropriate codes. 13 f. Underground storage tank monitoring system shall 14 be checked by a qualified service person. Tanks and monitor- 15 ing system shall meet the requirements of Vernon City Or- 16 dinance No. 944. 17 g. Replace the public fire hydrant at the west end 18 of the property with Vernon's new standard public fire 19 hydrant. 20 SECTION 4: The City Clerk of the City of Vernon 21 22 23 24 25 26 27 28 shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect.
