A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON ESTABLISHING AND ADOPTING A
SCHEDULE OF ENCROACHMENT LICENSE
LIABILITY INSURANCE LIMITS PURSUANT TO
CHAPTER 22, SECTION 22.74 OF THE CODE OF
THE CITY OF VERNON

WHEREAS, Chapter 22, Article III of the Code of the
7 City of Vernon provides for the issuance of encroachment
8 licenses and permits; and
9 WHEREAS, Section 22.74 of the Code of the City of
10 Vernon specifies that the City Council of the City of Vernon
11 shall establish a schedule of liability insurance limits on an
12 annual basis for encroachment licenses.
13 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
l4 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon
16 hereby finds and determines that the recitals contained
17
hereinabove are true and correct.

SECTION 2: That a policy or policies of public
19 liability and property damage insurance for encroachment
20 licenses involving nonhazardous facilities, equipment, and
21 materials shall be required with limits of One Million Dollars
22 and No Cents ($1,000,000.00) for General Liability and Two
23 Million Dollars and No Cents ($2,000,000.00) for Umbrella or
24 Excess Coverage including but not limited to the following:

A.
Underground storage tanks and pipelines containing
nonflammable liquidS such as water, food products,
27
and related items 1 conduits 1 and underground
28
tunnels used for passage1

B. Aboveground storage tanks and pipelines containing
nonflammable liquids such as food products, and
related materials1 lights, barricades, or warning
devices furnished andlor maintained1 signs,
rolling gates, metering manholes, footings and
related equipment1
C. Overhead signs, canopies, roof drains, overhead
cables less than two (2) inches
in diameter,
telephone cables, and related equipment.
SECTION 3: That a policy or policies of public
liability and property damage insurance for encroachment
licenses involving hazardous facilities, equipment, or material
shall be required with limits of Two Million Dollars and No
Cents ($2,000,000.00) for General Liability and Ten Million
DollarS and No Cents ($10,000,000.00) for Umbrella or Excess
Coverage including but not limited to the following:
A. Underground storage tanks and pipelines containing
flammable, combustible, or hazardous liquids, or
materials such as oils, sol vents, gasoline,
propane, LNG, or related chemicals1 and electrical
conduits which are for intrinsically safe circuits
used in the transmission or distribution or power
or electricitY1
B. Aboveground storage tanks and pipelines containing
flammable, combust'ible, or hazardous liquids or
materials
gasoline,
such as oils, solvents,

propane, LNG, or related chemicals 1 or electrical

conduits along a street1
C. Overhead conduits in excess of two (2) inches,

conveyor bridges and tunnels, pipe bridges or
pipelines, and related equipment or structures.
SECTION 4: Each policy or policies shall contain
statutory workers' compensation and employers' liabil i ty

coverage.

SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.
