RESOLUTION NO. 5782
3 A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
4 ANDRE COLLECTION, INC. FROM THE COMPREHEN-
SIVE ZONING ORDINANCE, SECTION 26.4.2-8,
5 DEVELOPMENT STANDARDS, FOR PROPERTY
LOCATED AT 4955 EVERETT COURT IN THE CITY
6 OF VERNON
7 WHEREAS, Andre Collection, Inc. has applied for an
8 occupancy inspection permit for a building which requires a
9 variance from the Comprehensive Zoning Ordinance, Section
10 26.4.2-8, Development Standards for the property located at 4955
11 Everett Court; and
12 WHEREAS, the physical condition of the property is
13 unique in that the existing 18,840 square foot building was con-
14 structed with a truck dock measuring 26.0 feet from the street
15 right-of-way and 18 feet wide; and
16 WHEREAS, Zoning Ordinance Section 26.4.2-7 requires
17 two loading spaces for a building with 8,001 to 25,000 square
18 feet in floor area, Section 26.4.2-8c specifies that each loading
19 space shall be a minimum of 10-feet wide and 65 feet long and
20 Section 26.4.6-4c provides that a non-conforming building must
21 comply with these standards with any changes in occupancy unless
22 a variance is granted; and
23 WHEREAS, the application of the development standards
24 for truck loading space sizing requirements will create an
25 unreasonable hardship by requiring that a 65 feet long by 20 feet
26 wide space be provided; and

WHEREAS, Andre Collection, Inc., has indicated that it
28 has no plans to expand or alter the building configuration and

that a 18 feet .wide by 26 feet .long loading space is suff icient
for the use intended; and
WHEREAS, 4955 Everett Court is located in the M
zone and the operation is consistent with the objectives of the
General Plan and Zoning Ordinance; and
WHEREAS, the City Council, of the City of Vernon held
a hearing on said application for a variance on July 3, 1990.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COONCIL OF
THE CITY OF VERNON AS FOLLOWS;
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from the requirement for two
loading spaces 10-feet wide by 65-feet long is hereby granted to
Andre Collection, Inc., at 4955 Everett Court on condition that
the loading bay 18-feet wide by 26-feet long be maintained.
SECTION 3: The variance shall be granted subject to
the following conditions: 1. The usage of the loading spaces
shall be limited to vehicles with a maximum length of 25 feet;
2. The owner shall construct frontage improvements along Everett
Court including but not limited to new curb, gutter, sidewalk,
driveway, and asphalt pavement all to be constructed to City of
Vernon Standards. The relocation of power poles and water
facilities will be funded and performed by the utilities.
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of

SECTION 5: The City Clerk of the City of Vernon shall
3 certify to the passage of this Resolution and thereupon and
4 thereafter the same shall be in full force and effect.
