RESOLUTION NO. 5784
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
ALLIED VENEER FROM THE COMPREHENSIVE
ZONING ORDINANCE, SECTION 26.4.2-8,
DEVELOPMENT STANDARDS, FOR PROPERTY
LOCATED AT 4901 FRUITLAND AVENUE IN THE
CITY OF VERNON
WHEREAS, Allied Veneer has applied for an occupancy
inspection permit for a building which requires a variance from
the Comprehensive Zoning Ordinance, Section 26.4.2-8, Development
Standards for the property located at 4901 Fruitland Avenue; and
WHEREAS, the physical condition of the property is
unique in that the existing 46,747 square foot building was con-
structed with a truck dock measuring 40.0 feet from the street
right-of-way and 30 feet wide and one recessed dock measuring 65
feet from the street right-of-way and 10 feet wide; and
WHEREAS, Zoning Ordinance Section 26.4.2-7 requires
three loading spaces for a building with 25,001 to 50,~ square
feet in floor area, Section 26.4.2-8c specifies that each~O~ding
space shall be a minimum of 10-feet wide and 65 feet long and
Section 26.4.6-4c provides that a non-conforming building must

comply with these standards with any changes in occupancy unless
a variance is granted; and
WHEREAS, the application of the development standards
for truck loading space sizing requirements will create an
unreasonable hardship by requiring that a 65 feet long by 30 feet
wide space be provided; and
WHEREAS, Allied Veneer has indicated that it has no
plans to expand or alter the building configuration and

that the 10 foot wide by 65 foot long loading space along with
the 30 foot wide by 40 foot long loading space is sufficient for
the use intended; and
WHEREAS, 4901 Fruitland Avenue is located in the M
zone and the operation is consistent with the objectives of the
General Plan and Zoning Ordinance; and
WHEREAS, the City Council, of the City of Vernon held
a hearing on said application for a variance on July 17, 1990.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS;
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from the requirement for three
loading spaces 10-feet wide by 65-feet long is hereby granted to
Allied Veneer at 4901 Fruitland Avenue on condition that all
existing loading bays be maintained.
SECTION 3: The variance shall be granted subject to
the following conditions: 1. The usage of the 40 foot long
loading spaces be limited to vehicles with a maximum length of 40
feet; 2. Any damage to the City of Vernon fence on the south
side of Fruitland Avenue caused by vehicles entering or exiting
the subject site shall be repaired by Allied Veneer within 3 days
of a written notice from the Director of Community Services.
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the applica~ion of

1 the authorized truck loading space requirement.
SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.
