Resolution No. 5809 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ 23 24 25 26 27 28 RESOLUTION NO. 5809 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO LEONARD MEAT COMPANY INC. FROM SECTION 26.4.2-8, DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR PROPERTY LOCATED AT 3217 44th STREET IN THE CITY OF VERNON WHEREAS, Leonard Meat Company Inc., has applied for an occupancy inspection permit for a building which requires a variance from Section 26.4.2-8, Development Standards, of the Comprehensive Zoning Ordinance, for the property located at 3217 44th Street; and WHEREAS, the physical condition of the property is unique in that the existing 13,000 square foot building was con- structed with two truck docks, one measuring 29.5 feet from the street right-of-way and 48.3 feet wide and the other dock measuring 38.5 feet from the street right-of-way and 11.1 feet wide; and WHEREAS, Zoning Ordinance Section 26.4.2-7 requires two loading spaces for a building with 8,001 to 25,000 square feet in floor area, Section 26.4.2-8c specifies that each loading space shall be a minimum of 10-feet wide and 65 feet long and Section 26.4.6-4c provides that a non-conforming building must comply with these standards with any changes in occupancy unless a variance is granted; and WHEREAS, the application of the development standards for truck loading space sizing requirements will create an unreasonable hardship by requiring that two 65 feet long by 10 feet wide spaces be provided; and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 WHEREAS, Leonard Meat Company Inc. has indicated that it has no plans to expand or alter the building configuration and that the 29.5 foot long by 48.3 foot wide loading space along with the 38.5 foot long by 11.1 foot wide loading space is sufficient for the intended use; and WHEREAS, 3217 44th Street is located in the M zone and the operation is consistent with the objectives of the General Plan and Zoning Ordinance; and WHER~AS, the City Council, of the City of Vernon held a hearing on said application for a variance on September 4, 1990. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS; SECTION 1: The City Council of the City of Vernon hereby finds and determ.ines that the recitals contained herein- above are true and correct. SECTION 2: A variance from the requirement for two loading spaces 10-feet wide by 65-feet long is hereby granted to Leonard Meat Company Inc. at 3217 44th Street on condition that 20 all existing loading bays be maintained. 21 22 23 24 25 26 27 28 SECTION 3: The variance shall be granted subject to the following condition; the usage of the 29.5 foot long loading spaces be limited to vehicles with a maximum length of 29 feet, and the usage of the 38.5 foot long loading space be limit.d to vehicles with a maximum length of 38 feet. SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect.
