Resolution No. 5816 . . 1 2 3 4 5 6 7 8 building RESOLUTION NO. 5816 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO CALIFORNIA BY-PRODUCTS FROM SECTION 26.4.2-6 AUTOMOBILE PARKING REQUIREMENTS AND SECTION 26.4.2-8(e), DEVELOPMENT STANDARDS (ACCESS), OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 5100 BOYLE AVENUE IN THE CITY OF VERNON WHEREAS, California By-Products proposes to occupy a which requires a variance from Section 26.4.2-6, 9 automobile parking requirements. and from Section 26.4.2-8(e), 10 Development Standards (access), of the Comprehensive Zoning 11 Ordinance. for the property located at 5100 Boyle Avenue; and 12 WHEREAS, the physical condition of the property is 13 unique in that the existing 23,850 square foot building was 14 constructed over the northerly two thirds of the property, and 15 has no existing truck loading facilities; and 16 WHEREAS, California By-Products proposes to occupy 17 the building and construct conforming truck loading and park- 18 ing facilities leaving insufficient space to meet the minimum 19 automobile parking requirements; and 20 WHEREAS, the parking lot for the existing building 21 is at the northeast corner of Boyle Avenue and Fruitland 22 Avenue with dimensions of approximately 92 feet wide by 174 23 feet long and California By-Products requires driveway access 24 on both Boyle Avenue and Fruitland Avenue for proper flow of 25 their proposed parking lot and the driveway on Boyle Avenue 26 will only be 24 feet from the tangent point of the proposed 50 27 foot radius curb return; and 28 WHEREAS, Zoning Ordinance Section 26.4.2-6 requires 1 1 27 automobile parking spaces for the proposed use, Section 2 26.4.2-8(e) specifies that the curb cut for a driveway used by 3 trucks shall not be permitted within 75 square feet of the 4 point of tangency of any curb return and Section 26.4.6-4(b) 5 and (d) provides that a non-conforming building must comply 6 with these standards with any expansion unless a variance is 7 granted; and 8 WHEREAS, the application of the minimum automobile 9 parking requirements and driveway development standards will 10 create an unreasonable hardship by requiring 27 automobile 11 parking spaces and the removal of an existing driveway; and 12 WHEREAS, California By-Products has indicated that 13 it has only 15 parked automobiles at peak times at its present 14 site and that 17 automobile parking spaces are sufficient for 15 the intended use; and 16 WHEREAS, 5100 Boyle Avenue is located in the M zone 17 and the operation is consistent with the objectives of the 18 General Plan and Zoning Ordinance; and 19 WHEREAS, the City Council of the City of Vernon held 20 a hearing on said application for a variance on September 4, 21 1990. 22 23 24 25 26 27 28 NOW, THEREFORE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: A variance from the minimum automobile parking requirements and the driveway development standard is 2 1 hereby granted to California By-Products at 5100 Boyle Avenue 2 on the condition that 17 automobile parking spaces, as shown 3 on the plan submitted with their application. are maintained. 4 SECTION 3: The variance shall be granted subject to 5 the following conditions: 6 1. Cali fornia By-Products operation shall not cause 7 anyon-street parking and the maximum number of parked 8 automobiles on this site shall be 17. 9 2. The property owner shall construct all frontage 10 improvements including but not limited to a new 50 foot radius 11 curb return at the northeast corner of Boyle Avenue and Fruit- 12 land Avenue and associated catch basin and benchmark monument 13 relocations, new curb. gutter, sidewalk and handicap ramp con- 14 struction. The property owner shall deed a portion of his 15 property so the curb return improvement can be constructed. 16 The new property line radius shall be 40 feet. 17 3. A 30" high barrier wall shall be constructed 18 where the parking adjoins the public right-of-way and guard 19 posts shall be installed at the ends of the driveways. All 20 existing frontage improvements shall be repaired to present 21 City standards. 22 4. The driveway on Fruitland Avenue shall be used 23 exclusively as an entrance for vehicles. The driveway on 24 Boyle Avenue shall be used only by vehicles exiting the site. 25 Right turns only will be allowed onto Boyle Avenue. Signs 26 shall be posted stating all restrictions. 27 SECTION 4: Noncompliance with these conditions 28 shall constitute sufficient grounds for the City Council of 3 . . 1 the City of Vernon to void this variance and require the ap- 2 plication of the authorized truck loading space requirement. 3 SECTION 5: The City Clerk of the City of Vernon 4 shall certify to the passage of this resolution and thereupon 5 and thereafter the same shall be in full force and effect. 6 7 1990. 8 APPROVED AND ADOPTED this 4th day of September, ...~ . _ ':./"1 L--1~ /~ ~~;:t?~~ ~:"~ ,- pC.~!
