RESOLUTION NO. 5826
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON REPEALING RESOLUTION NO.
5752 WHICH APPROVED AND AUTHORIZED THE
EXECUTION OF AN INTERRUPTIBLE GAS SALE AND
PURCHASE AGREEMENT BY AND BETWEEN THE CITY
OF VERNON AND MOCK RESOURCES, INC.
PROVIDING FOR GAS PURCHASES
WHEREAS, the City Council of the City of Vernon adopted
7 Resolution No. 5752 on May 15, 1990, which approved and
8 authorized the execution of an Interruptible Gas Sale and
9 Purchase Agreement with Mock Resources, Inc. (Mock); and
WHEREAS, by letter dated August 30, 1990, Bruce V.
11 Malkenhorst, the City Administrator/City Clerk, has recommended
12 that Resolution No. 5752 be rescinded because negotiations with
13 Mock have failed to produce a final agreement.
14 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
15 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon
17 hereby finds and determines that the recitals contained
18 hereinabove are true and correct.

SECTION 2: The City Council of the city of Vernon
20 hereby repeals Resolution No. 5752.

SECTION 3: The City Clerk of the City of Vernon shall
certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.
APPROVED AND ADOPTED this 4th day of September, 1990.

status of agreements
Per our discussion, this is to confirm that the
Department has stopped negotiating with PSI, Inc. and
Mock Resources. There were a few sections in the PSI
agreement that could not be agreed upon. It was believed
that these sections could have been worked out, but PSI
did not follow through. The agreement with Mock
Resources was stalled by Mock's failure to submit
historical data on the proposed pricing index.
At this time there is very Ii tt Ie benefit, i f any, to
proceed with finalizing any arrangements. The Department
plans to continue procuring agreements next spring when
natural gas use will increase from the expected
curtailments during the fall and winter. The proposed
agreement with Southern California Gas Co. will be
postponed and rev isi ted at such time a gas purchase
agreement is entered into.
I have attached a draft copy of the above agreements.
