Resolution No. 5827 ".. 1 2 RESOLUTION NO. 5827 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON REPEALING RESOLUTION NO. 5753 WHICH APPROVED AND AUTHORIZED THE EXECUTION OF A GAS SALES AGREEMENT BY AND BETWEEN THE CITY OF VERNON AND PSI, INC. PROVIDING FOR GAS PURCHASES 4 5 6 7 WHEREAS, the City Council of the City of Vernon adopted Resolution No. 5753 on May 15, 1990, which approved and authorized the execution of a Gas Sales Agreement with PSI, 8 Inc.; and 9 10 11 12 WHEREAS, by letter dated August 30, 1990, Bruce V. Malkenhorst, the City Administrator/City Clerk, has recommended that Resolution No. 5753 be rescinded because negotiations with PSI, Inc. have concluded without producing a final agreement. 13 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 14 15 16 17 18 THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. 19 SECTION 2: The City Council of the City of Vernon hereby repeals Resolution No. 5753. 20 21 SECTION 3: The City Clerk of the city of Vernon shall certify to the passage of this resolution and thereupon and 22 23 24 25 26 thereafter the same shall be in full force and effect. Somoano, Power Resource Planner SUBJ: status of agreements Per our discussion, this is to confirm that the Department has stopped negotiating with PSI, Inc. and Mock Resources. There were a few sections in the PSI agreement that could not be agreed upon. It was bel ieved that these sections could have been worked out, but PSI did not follow through. The agreement with Mock Resources was stalled by Mock's failure to submit historical data on the proposed pricing index. At this time there is very little benefit, if any, to proceed wi th final izing any arrangements. The Department plans to continue procuring agreements next spring when natural gas use will increase from the expected curtailments during the fall and winter. The proposed agreement with Southern California Gas Co. Hill be pos tponed and rev is i t ed a t such time a gas purchase agreement is entered into.
