A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON APPROVING AND AUTHORIZING
THE EXECUTION OF AN AGREEMENT FOR SPECIAL
SERVICES BY AND BETWEEN THE CITY OF VERNON
AND LIEBERT, CASSIDY & FRIERSON TO PROVIDE
SPECIAL LEGAL SERVICES PERTAINING TO
EMPLOYMENT RELATIONS MATTERS

WHEREAS, the City ef Vernen has a need fer specialized
7 legal services pertaining to empleyment relatiens matters; and
8 WHEREAS, Bruce V. Malkenherst, city Administrater/City
9 Clerk, by letter dated Octeber 10, 1990, has recemmended that
10 the City ef Vernen retain the law firm ef Liebert, cassidy &
11
Friersen to. previde said legal services
based upen the
12 recemmendatien ef Jean Francene, the City'S Risk Manager; and
13
WHEREAS, the law firm ef Liebert, cassidy & Friersen
14 has agreed to. previde said legal services in accerdance with an
15 Agreement fer Special Services submitted cencurrently herewith.
16 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
17 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Ceuncil ef the City ef Vernen
19 hereby finds and determines that the recitals centained
20 hereinabeve are true and correct.

SECTION 2: The City Council ef the city ef Vernen
22 hereby appreves the Agreement For Special Services, a cepy ef
23 which has been presented to the City Council cencurrently with
24 this reselutienand the City Ceuncil hereby erders said
25 Agreement to. be received and filed by the City Clerk.

SECTION 3: The City Council ef the City ef Vernen
27 hereby autherizes the Mayor and the city Clerk to. execute said
28 Agreement fer, and en behalf ef, the City of Vernen.

SECTION 4: The City Clerk of the City of Vernon shall

certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.

AGREEMENT FOR SPECIAL SERVICES
This Agreement is made this /h dday of o.~d~, 1990,
benveen the law firm of LIEBERT, CASSIDY & FRIERSON, A Professional Corporation,
hereinafter referred to as "Attorney", and the CrTY OF VERNON, A Municipal
Corporation, hereinafter referred to as "City".
Attorney agrees to provide City consulting, representational and legal servIces
pertaining to employment relations matters, including representation in negotiations and in
administrative and court proceedings as requested by the City. The place and time for such
services are to be designated by the City.

City hereby designates Attorney as its special counsel for employment relations and
agrees to pay Attorney at the rate of One Hundred Ten to One Hundred Seventy-Five
Dollars ($110.00 - $175.00) per hour for services provided by attorney staff, Sixty-Five
Dollars ($65.00) for services provided by paralegal staff, including reasonable travel time
and any necessary costs and expenses authorized by the City.
It is expressly understood and agreed that Attorney, while engaged in carrying out
and complying with any of the terms of this Agreement, is an independent contractor and
is not an employee of the City.
The term of this Agreement will be from September 5, 1990, through August 31,
1991.
