RESOLUTION NO. 5846
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
METRO PADS AND FUSING FROM SECTION
26.4.2-8, DEVELOPMENT STANDARDS OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR THE
PROPERTY LOCATED AT 3850 SANTA FE AVENUE
IN THE CITY OF VERNON.
WHEREAS, Metro Pads and Fusing has submitted plans for
a proposed building which requires a variance from Section
26.4.2-8, Development Standards, of the Comprehensive Zoning
Ordinance, for the property located at 3850 Santa Fe Avenue;
and
WHEREAS, the physical condition of the property is
unique in that it is 100 feet wide and 635 feet long and less
than 5% of the properties in Vernon have these proportions.
The
property has an existing 20,800 square foot building constructed
on it; and
WHEREAS, the owner is proposing to construct a 15,360
square foot building on the rear of the lot with six truck
loading and parking spaces; and
WHEREAS, Zoning Ordinance Section 26.4.2-7 requires
three truck loading spaces for a building with 25,001 to 50,000
square feet in floor area, and two truck parking spaces for a
manufacturing use, and that each space shall be a minimum of
10 feet wide and 65 feet long and Section 26.4.6-4e specifies
that a minimum forty (40) feet of unobstructed space shall be
maintained in front of all truck loading and parking spaces for
maneuvering; and
WHEREAS, the application of the development standards
for truck and parking loading space sizing requirements will

create an unreasonable hardship by causing the five 65-feet
long by 10-feet wide spaces with a 40-foot long maneuvering area,
to be layed out in the parallel to the 100-foot dimension of the
lot; and
WHEREAS, the strict application of the development
standard will create an unreasonable hardship by reducing the
allowable building space by more than 20%; and
WHEREAS, sixty-five feet long trucks traveling in the
northbound direction cannot maneuver into the existing twenty
foot wide aisle leading to the back portion of the property
without blocking traffic on Santa Fe Avenue; and
WHEREAS, Metro Pads and Fusing has indicated that they
will limit the size of the truck entering the site to 40 feet
in length and that 40-foot loading and parking spaces are
sufficient for the intended use; and
WHEREAS, the variance will not adversely affect the
interests of the public or the interests of other residents and
property owners within the vicinity of the premises in question;
and
WHEREAS, the granting of the variance does not
constitute the granting of a special privilege which is
inconsistent with the limitations of other nearby properties
because four parcels in close vicinity of the subject site are
also in nonconformance with the Comprehensive Zoning Ordinance
due to the narrowness of their lots. The Los Angeles County
Assessor numbers for these lots are 6302-18-07, 6302-15-16,
6302-15-17 and 6302-15-18; and
WHEREAS, Metro Pads and Fusing will restrict the

1 property to industrial or manufacturing use only; and
2 WHEREAS, 3850 Santa Fe Avenue is located in the M zone
3 and the operation is consistent with the objectives of the
4 General Plan and Zoning Ordinance; and
5 WHEREAS, the City Council, of the City of Vernon held a
6 hearing on said application for a variance on November 6, 1990.
7 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
8 THE CITY OF VERNON AS FOLLOWS;
9 SECTION 1: The City Council of the Vernon hereby finds
10 and determines that the recitals contained hereinabove are true
11 and correct.
12 SECTION 2: A variance from the requirement for five
13 loading and parking spaces 10-feet wide by 65-feet long, with a
14 40 foot long maneuvering area is hereby granted to Metro Pads and
15 Fusing at 3850 Santa Fe Avenue on condition that all existing
16 loading bays be maintained.
17 SECTION 3: The variance shall be granted subject to
18 the following conditions:
19 1. The owner shall provide a 40-foot long maneuvering
20 area in front of the six 40-foot long loading and parking spaces
21 and shall limit the length of vehicles entering the site to a
22 maximum overall length of 40-feet.
23 2. The owner shall provide a minimum 20 foot clear
24 driveway aisle leading to all auto, truck loading or truck
25 parking spaces.
26 3. The owner shall provide a covenant to the city
27 agreeing to limit the use of the buildings on this site to
28 manufacturing or industrial uses only and to limit all trucks

entering the site to 40 feet in overall length.
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
the authorized truck loading space requirement.
SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.
