Resolution No. 5852 -, 'f f 1 RESOLUTION NO. 5852 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON VOIDING A CONDITIONAL USE PERMIT GRANTED BY RESOLUTION NO. 5738 TO P. I . E. NATIONWIDE FOR THE OPERATION OF A TRUCK AND FREIGHT TERMINAL AT 3575 ROSS STREET 4 5 6 7 WHEREAS, the city Council of the City of Vernon by 8 Resolution No. 5738 granted a conditional use permit to P.I.E. 9 Nationwide on April 10, 1990 allowing them to operate a truck lO and freight terminal at 3575 Ross Street subj ect to the II conditions required by the permit; and l2 WHEREAS, condition number 3a required that, "The l3 facility shall be operated in accordance with the appropriate 14 codes, rules, regulations and subject to permit fees as adopted 15 by the City of Vernon. Prior to occupancy a business license 16 and occupancy permit shall be obtained"; and 17 WHEREAS, condition number 3h required that, 18 "Underground storage tank monitoring system shall be checked by - '19 a qualified - service person. Monitoring system must meetnthe 20 requirements of Vernon City Ordinance No. 944"; and 2l WHEREAS, the required fees on the Annual Health Permit 22 renewal for the underground tanks are delinquent and the 23 inspection required by condition number 3h has not been 24 conducted; and 25 WHEREAS, condition number 3e required that, "Where 26 parking areas adjoin a public street or streets, a masonry wall 27 not less than 30 inches in height or landscaped area a minimum 28 of 4 feet in width, measured from the property line, shall be 1 2 3 4 5 6 7 8 9 10 II l2 l3 14 15 l6 17 18 19 20 2l 22 23 24 25 26 27 28 ., . 1 established along such frontage, except at driveways, walkways, or where other openings are necessary"; and WHEREAS, P. I. E. Nationwide received a Temporary Occupancy Permit effective June 21, 1990, commenced operations pursuant to said permit, and said permit provided that the frontage improvements and barrier wall shall be constructed within 30 days of June 21, 1990; and WHEREAS, P.I.E. Nationwide has been notified on several occasions that these items must be completed in a timely manner, however, to this date they have failed to commence work; and WHEREAS, condition number 3g required that, "A 60 foot curb return with an 8 foot wide sidewalk shall be constructed on Ross Street at the northeast corner of the subject site. Sufficient right-Of-way shall be deeded to the City for this construction. All non-standard driveways shall be removed and replaced with curb, gutter and sidewalk. All cracked and broken sidewalk, curb or gutter shall be repaired as directed by the Director of Community Services"; and WHEREAS, such right-Of-way has not been deeded to the City and no improvement plans have been received; and WHEREAS, the Director of community Services has recommended that the conditional use permi t granted to P. I . E. Nationwide be voided pursuant to Zoning Ordinance Section 26.5.2-10. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: III -2- SECTION 1: The City Council of the City of V.rnon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the city of Vernon hereby finds that the conditions of said conditional use permit have not been complied with. SECTION 3: The City council of the City of Vernon declares and determines that said conditional use permit is void and that Resolution No. 5738 shall have no further force and effect. SECTION 4: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect.
