RESOLUTION NO. 5863
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO CAROLINA WESTERN EXPRESS, INC.
FOR THE OPERATION OF A TRUCK AND FREIGHT
TERMINAL AT 3575 ROSS STREET
WHEREAS, Carolina Western Express, Inc. has applied
6 for a conditional use permit to operate a truck and freight
7 terminal at 3575 Ross Street; and
8 WHEREAS, the City council of the City of Vernon held
9 a hearing on said application for a conditional use permit on
10 December 18, 1990; and
11 WHEREAS, the proposed site is a non-conforming use
12 in the General Industry (M) Zone which has been continuously
13 used as a truck and freight terminal and requires a condi-
14 tional use permit under the Zoning Ordinance in order to con-
15 tinue the use; and
16 WHEREAS, the proposed site is adequate in size,
17 shape and topography for the proposed operation, has adequate
18 drainage, and landscaping if required will be installed
19 pursuant to the Vernon City Code; and
20 WHEREAS, the proposed site is surrounded by in-
21 dustrial uses compatible with the proposed use and no adverse
22 effect from traffic, parking noise, odors, dust, smoke, light
23 or glare, or risk of fire, infection or explosion is an-
24 ticipated from the proposed operation; and
25 WHEREAS, the site has access to Ross Street, and
26 traffic will travel from the site on Ross street to either
27 Alameda Street or 38th Street and Bandini Boulevard. All of
28 said streets are located in the City of Vernon and are of

adequate width and pavement type to handle the traffic gen-
erated from the proposed operations; and
WHEREAS, the site is required to have adequate off-
street parking and loading facilities in accordance with the
Vernon City Code; and
WHEREAS, the conditions imposed on the conditional
use permit will adequately protect the public health, safety
and general welfare and the operation is consistent with all
applicable rules and laws of the City of Vernon; and
WHEREAS, the proposed use as to location, operation,
and design is consistent with the General Plan and the Zoning
Ordinance of the City of Vernon.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained here-
inabove are true and correct.
SECTION 2: The conditional use permit to Carolina
Western Express, Inc. for the operation of a truck and freight
terminal at 3575 Ross Street is granted.
SECT~ON 3: In order to adequately protect the
public health, safety and general welfare the following
conditions are imposed:
a. The facility shall be operated in accordance
with the appropriate codes, rules, regulations and subject to
permit fees as adopted by the City of Vernon. Prior to oc-
cupancy a business license and occupancy permit shall be ob-
tained.

b. Any hazardous substances used or handled shall
have prior approval from the Vernon Fire and Health Depart-
ments.
c. The number of parking spaces required per Vernon
City Code shall be provided and maintained.
d. All parking and loading facilities shall be
paved with a hard, durable surface material and shall be
adequately drained, and kept free of dust, mud, trash or
weeds.
e. Where parking areas adjoin a public street or
streets, a masonry wall not less than 30 inches in height or
landscaped area a minimum of 4 feet in width, measured from
the property line, shall be established along such frontage,
except at driveways, walkways or where other openings are
necessary. Construction shall be completed within sixty days
of the issuance of the conditional use permit or any extension
thereof as approved by the Director of Community Services.
f. Servicing of vehicles including waShing, steam
cleaning and repairing shall be performed in compliance with
appropriate codes.
g. A 60 foot curb return with an 8 foot wide
sidewalk shall be constructed on Ross street at the northeast
corner of the subject site. Sufficient right-Of-way shall be
deeded to the City for this construction. All non-standard
driveways shall be removed and replaced with curb, gutter and
sidewalk. All cracked and broken sidewalk, curb or gutter
shall be repaired as directed by the Director of Community
Services. All construction shall be completed within sixty

days of the issuance of the conditional use permit or any
extension thereof as approved by the Director of Community
Services.
h. The underground storage tank monitoring system
shall be checked bya qualified service person. The monitor-
ing system must meet the requirements of Vernon City Ordinance
No. 944.
i. Carolina Western Express, Inc. shall pay for the
replacement of the old style Matthews fire hydrant, located in
the public right-of-way adjacent to the southeast corner of
SUbject site, with the new City of Vernon standard.
SECTION 4: The city Clerk of the City of Vernon
shall certify to the passage of this resolution and thereupon
and thereafter the same shall be in full force and effect.
