RESOLUTION NO. 5865
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
ANGELUS SANITARY CAN MACHINE COMPANY
FROM SECTION 26.4.6-4, INADEQUATE OFF-
STREET PARKING, ACCESS AND LOADING OF
THE COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 4900 PACIFIC BLVD.
IN THE CITY OF VERNON.
WHEREAS, Angelus Sanitary Can Machine Company has
submitted plans for a proposed building which requires a variance
from Section 26.4.6-4, Inadequate Off-Street Parking, Access and
Loading, of the Comprehensive Zoning Ordinance, for the property
located at 4900 Pacific Blvd.;and
WHEREAS, the physical condition of the property is
unique in that it is approximately ten acres in size and has
existing buildings totaling 260,630 square feet in size on it;
and
WHEREAS, the owner is proposing to construct a 5,054
square foot addition; and
WHEREAS, Zoning Ordinance Section 26.4.6-4, Inadequate
Off-street parking, Access or loading, states that compliance
with off-street parking and loading requirements shall occur at
the time of any expansion or structural alteration of the
building on the subject lot; and
WHEREAS, Zoning Ordinance Section 26.4.2-7 requires six
truck loading spaces for this facility and fourteen truck parking
spaces for a manufacturing use, and that each space shall be a
minimum of 10 feet wide and 65 feet long and Section 26.4.6-4e
specifies that a minimum forty (40) feet of unobstructed space
shall be maintained in front of all truck loading and parking

spaces for maneuvering; and
WHEREAS, a portion of the Angelus Sanitary Can
Machine Company's existing facility was developed in 1910 on a
section of the current site and since that time the facility has
grown to its current size. There is no vacant land in the area
for them to develop onto; and
WHEREAS, Angelus Sanitary Can Machine Company existing
facility was completely built out in conformance with past City
Codes and the strict application of the Zoning Ordinance will
create an unreasonable hardship by causing them to demolish a
portion of their already crowded facility to meet the truck
parking and loading requirements; and
WHEREAS, Angelus Sanitary Can Machine Company has a
unique operation in that they only require two truck loading
needs per week and require an infrequent number of deliveries by
small trucks and vans due to the intricacy of the machinery they
manufacture; and
WHEREAS, the variance will not adversely affect the
interests of the public or the interests of other residents and
property owners within the vicinity of the premises in question;
and
WHEREAS, the granting of the variance does not
constitute the granting of a special privilege which is
inconsistent with the limitations of other nearby properties
because of the unique operation; and
WHEREAS, 4900 Pacific Blvd. is located in the M zone
and the operation is consistent with the objectives of the
General Plan and Zoning Ordinance; and

WHEREAS, the City Council, of the City of Vernon held a
hearing on said application for a variance on December 18, 1990.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS;
SECTION 1: The City Council of the Vernon hereby finds
and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: A variance from the requirement for six
truck loading and fourteen truck parking spaces 10-feet wide by
65-feet long, with a 40 foot long maneuvering area is hereby
granted to Angelus Sanitary Can Machine Company at 4900 Pacific
Blvd. on condition that all existing loading bays shall be
maintained.
SECTION 3: The variance shall be granted subject to
the following conditions:
1. Upon any change in use or occupancy of all or a
portion of the site, the entire site shall be made to conform to
all truck and auto parking requirements and all truck loading
requirements.
2. No street truck loading or parking shall occur as a
by product of Angelus Sanitary Can Machine Company's operation.
3. Angelus Sanitary Can Machine Company shall maintain
five conforming truck loading or truck parking spaces or a
combination thereof on the subject site.
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
the authorized truck loading space requirement.

SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.
