A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON APPROVING AND AUTHORIZING
THE EXECUTION OF AN ADDENDUM TO IN LIEU
REPLENISHMENT AGREEMENT (JULY 1, 1990 -
JUNE 30, 1991) BY AND BETWEEN THE CITY OF
VERNON AND THE CENTRAL AND WEST BASIN
WATER REPLENISHMENT DISTRICT

WHEREAS, on July 17, 1990, the City Council of the City
7 of Vernon adopted Resolution No. 5786 which approved and
8 authorized the execution of a 1990-91 In Lieu Replenishment
9 Agreement between the City of Vernon and the Central and West
10 Basin Water Replenishment District ("Replenishment District");
11 and
12
WHEREAS, the City of Vernon and the Replenishment
13 District wish to enter into an addendum to the Agreement to
14 modify the price per acre foot to be paid by the Replenishment
15 District to the City of Vernon for certain categories of in lieu
16 replenishment water.
17 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
18 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon
20 hereby finds and determines that the recitals contained
21 hereinabove are true and correct.

SECTION 2:
The City Council of the City of Vernon
23 hereby approves the Addendum to In Lieu Replenishment Agreement
24 July 1, 1990 - June 30, 1991, a copy of which has been presented
25 to the City Council concurrently with this resolution and the
26 Ci ty Council hereby orders said Addendum, to be received and
27 filed by the City Clerk.

SECTION 3: The city Council of the city of Vernon
1 hereby authorizes the Mayor and the City Clerk to execute said
2 Addendum for, and on behalf of, the city of Vernon.

SECTION 4: The City Clerk of the City of Vernon shall
4 certify to the passage of this resolution and thereupon and
5 thereafter the same shall be in full force and effect.
6 APPROVED AND ADOPTED this 15th day of January, 1991.

ADDENDUM TO IN LIEU REPLENISHMENT AGREEMENT
JULY 1, 1990 - JUNE 30, 1991
THIS AGREEMENT constitutes an Addendum to that certain In Lieu
Replenishment Agreement entered into between CENTRAL AND WEST BASIN WATER
REPLENISHMENT DISTRICT, a public entity ("Replenishment District") and
CITY OF VERNON ("Producer"), dated as of July 1, 1990, with
reference to the following:
a. The parties have previously entered into the In Lieu Replenishment
Agreement, which Agreement sets forth certain rates of payment per acre foot for certain
in lieu replenishment water.
b. By this Addendum, the parties wish to modify the price per acre foot to
be paid by the Replenishment District to the Producer for certain categories of in lieu
replenishment water.
IT IS AGREED AS FOLLOWS:
1. Paragraph C4(b) of the In Lieu Replenishment Agreement is hereby
modified by s~bstituting "$75.00 per acre foot" for "$55.00 per acre foot."
2. Paragraph C4(e) is hereby modified by substituting "$75.00 per acre foot"
for "$55.00 per acre foot. "
3. The effective date of this Addendum shall be as of July 1, 1990.

4. In all other respects, the parties confirm and ratify the terms
of the In Lieu Replenishment Agreement.
