A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON RESCINDING RESOLUTION NO.
5867 WHICH APPROVED AND AUTHORIZED THE
EXECUTION OF A CONSULTING AGREEMENT BY AND
BETWEEN THE CITY OF VERNON AND SUNLAW
FUELS

WHEREAS, the City Council of the City of Vernon adopted

Resolution No. 5867 on January 1, 1991, which approved and
7
authorized the execution of a Consulting Agreement with Sunlaw
8
Fuels; and
9
WHEREAS, by letter dated February 14, 1991, Bruce V.
10
Malkenhorst, the City Administrator/City Clerk, has recommended
11

that Resolution No. 5867 be rescinded because negotiations with
Sunlaw Fuels have been terminated.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
14
THE CITY OF VERNON AS FOLLOWS:

SECTION 1:
The city Council of the city of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct.

SECTION 2:
The City Council of the City of Vernon
19
hereby repeals Resolution No. 5867.

SECTION 3: The City Clerk of the City of Vernon shall
certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.
APPROVED AND ADOPTED this 19th day of February, 1991.

Honorable Members:
Approval was previously granted to enter into an agreement with
Sunlaw Fuels for negotiating purchases of natural gas supplies.
Further meetings have been held specifically pertaining to the
liability provision of the contract. Sunlaw cannot accept the
hold harmless and liability provisions. This has been reviewed
by the City Attorney and it is hereby recommended that further
negotiations be terminated and Resolution No. 5867 be rescinded.
