A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON RESCINDING RESOLUTION NO.
5808 WHICH APPROVED AND AUTHORIZED THE
EXECUTION OF A FIRM POWER SALE AGREEMENT
BY AND BETWEEN THE CITY OF VERNON AND UTAH
ASSOCIATED MUNICIPAL POWER SYSTEMS (UAMPS)

WHEREAS, the City Council of the City of Vernon adopted
Resolution No. 5808 on September 4, 1990, which approved and

authorized the execution of a Firm Power Sale Agreement with
8
Utah Associated Municipal Power systems ("UAMPS"); and
9
WHEREAS, the Firm Power Sale Agreement with UAMPS was
10

never executed because UAMPS had proposed certain modifications;
and
12
WHEREAS, in order to purchase from UAMPS, Vernon had
13
requested Firm Transmission Service from the City of Pasadena;
14
and
15

WHEREAS, Pasadena had imposed certain economic
conditions for the firm service which made it less advantageous
to Vernon; and
18
WHEREAS, Vernon and Southern California Edison Company
19
entered into a Settlement Agreement in November of 1990 in FERC
20
Docket No. ER88-83 which affected the benefits to be derived
21

from the Firm Power Sale Agreement; and
WHEREAS, by letter dated February 14, 1991, Bruce V.
24
Malkenhorst, the City Administratorlcity Clerk, has recommended
that Resolution No. 5808 be rescinded.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:

hereby finds and determines that the recitals contained
SECTION 1: The City Council of the City of Vernon

hereinabove are true and correct.

SECTION 2: The City Council of the city of Vernon
hereby repeals Resolution No. 5808.
SECTION 3: The City Clerk of the City of Vernon shall
6

certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.

Honorable Members:
The Light and Power Department staff has been reviewing various
resource options at the City Council's direction. Vernon has now
entered intQ a Settlement Agreement with Edison for rate issues
in Rate Case FERC Docket No. ER88-83. This agreement gives us a
firm rate for settlement.

Council had previously approved resolutions for agreements and
negotiations with Ut.ah Associated Municipal Power Systems (Resolution
No. 5808), ealifgrnia De.partmehL of Wa.La::.L Rcse1;lrcQ~ (n~!:l() lnti()n No.
S7S4~ and Salt River Project (Resolution No. 5718)~ and based on
the firm settlement rate and the present negotiation stand of the
other agencies, it is hereby recommended that the aforementioned resolutions
and agreements be rescinded. This matter has been reviewed in depth
by the Light and Power staff and the City Attorney.
